- in pursuance of the'evarrant, a patent from the
Commonwealth for the land to Everhart in 1911,
and regular conveyances from Everhart down to
himself.
The' Everhart survey was four sided. had been
actually-run- - on the ground, the lines being well
marked, and instead of containing only 299 acres,
actually contained about 390, two of the parallel
lines of the tract having been run 102 perches
further than the return of stirvey celled for.
The pitff. contended that the deft. was not enti
tled to the excess of land. beyond the amount of
the warrant and return of survey—that since the
`act of 1830 a greater excess than ld per cent. conkd
nut be surveyed, and if it were done, aonktgive
no title to such excess,

divest the title of the Commonwealth.

cargoes of coal sold to this deft., amounting to
494 tons of prepared coal, at SL 90 per ton, and
55 tuns of Chesnut coal, at 75 cents per ton. The
Coal was mined at the Novelty Colliery, in Blythe_
township, end w4s delivered upon the sth, 6th and
7th of October last. The .defence to this suit:was,
that it was improperly brought—that the coal was
not purchased , from the Olaf., or from George '
Rickert, his agent, hot from tleorge Rickert, the
agent of the4liners' Bank, and against whom
deft. claimed to have a_ valid defence, but which
he could not set up`in this cation—that the suit
should hare been brought in the name of the
Dank, for the use of.Linder.
On the 25th of September; the collierjene Old
at Sheriff's sale to the Miners' Bank, and a few
''day's afterstatds they. agreed to still it to, Linder.
on certain conditiosq. He paid $lllOO down at the
time of the egreement, which was to be refunded

the Bank was to retenipossession until he should
