'prohibited it, and imposed a fine of $4 for so
defog. Now the Court says the License
confers the right to do certain' things on
Sunday, but prohibits liquor selling on that

ded on Sunday, as far as liquor selling es
concerned, because h is worldly employment:

Mayor, sustaining his course in the position
he has taken, as follows
Dear Sir:—lsis proper, since the alleged
decision of the Supreme Court, id the case
of Daniel Barr, that I should communicate
to you, officially the.view I have of , the ire:
meaning cases of Sunday tippling, and diior,
derly houses, heard before you. It it my
wish,that all the lemma should he made to
tins office without reference:to the action of
>the Supreme Court .in Barr's case s nOt. of
course with any idea of evading the fall force
of that decision, whatever it as, but' that the
Grand Jory may inquire into the circum
stances f. each ease and decide how fir, io
very familiar terms, +be charge of disorderly
house, or Ditionee, is sustained. Until the
promised opifiion of t he Supreme Court shall
be published, we have no means 'of ascer
taining the extent or finiitatimi of the doc
trine it asserts. It now is, the Supreme
Court on on ex parse-hearing, and: , after: the
examination of a Comrounwealth witness, I
presume by the defendant's counsel, decided
that Denier Barr should btdiscbarged. They
further decided, as I infer, that the mere
sale of a glass of liquor, ss an item of worldly
business On Sunday, without a crowd of ems
' tamers and disiirder, couldnot be prosecuted
by indictment, -
But they did not decide. and I earnestly
trust they never will, that the open and scan
dalous sale ofintoxicating liquors, on a day
consecrated be law to rest and decorum, is
not an indictable misdemeanor. :The open
ing of a liquor stand or bar, or tavern, with,
its appendage of idlers and tipplers, annoy
tog anti scandalizing the quiet citizens who
pass and repass to placetot worship, is yet,
the mointaining of a nuisance, and
bench indictable in Pennsylvanii. A strict
et rule as to order and disosilt4' applies to
Sunday than to other days. •
' That which:would constitute no percepti
ble disorder on days and at hours when the
•bnsy world is active, might becbnie mist of
fensive when business is suspendedi and
there is positive and relative imttqudits.—

those heard before you and whichl feel it
my duty to investigate thoroughly. Surely
the Supreme Court do not mean to ektend
protection to such places of infamous resort:
