cording to law, deposed as follows:

tion with Colonel M. Porter, of &tatty), previous
to the meeting of the Legislature, on thqq subject of
__the contested election in the county of Philadelphia?
If yea. please to state. the same fully.
Ans.—l had a ctonversatiun of that kind with
Col. Porter about etyht Jr ten days. previous to the
meeting or the Legoluture; I remarked, 1 believe.
that the Whig members of.lte county of Philadel
pllia, would take thetr watt; on the first day the Le
gislature inct. Mr: Porter replied they would not ;
that there to,uld be nt. flat risburg one thousand able
bodied men from various sections of the State on the
. day of the meeting of the Legtslatute. who were de
termined not to •see /heir raghts trampled upon ; that
if the Whig members from the county of Phila
delphia attempt to 'take their seats they would be
thrown out of the windows. 1 remarked in reply to

ships and the Yam boroughs. are at the above mentioned
day and place, to vote by ballot fin,one person as Judge,
for one person as Inspector of elediton. and for one per
son as A ssessor in their respective districts, boroughs
and townships, and the person having the greatest num
ber of votes for Judge is to be publicly declared to be the
judge of eJections. the two persons having the greatest
number of voles for uispectors are to be publicly (feeler
ed to be the inspectors of elections, and the person hav
ing the highest numuer of votes for assessor shall be the
assesor.
The said elections for judge* and Inspector, of elec
tions and assessor, are to be opened between the hours
of eight and ten o'clock in the firreimou, and to be kept
open until seven o'clock in the afternoon of the said 4th
day of October, 1839. when the polls shall be cloned, the
number of votes be forthwith a tcertained, and the per
sons highest in vote publicly declared to be elected.
ln pursuance of an Act of the (Gen sal Assembly of
the Commonwealth of Pennsylvania, entitled. "an act re
lative to the elections in this Commonwealth." passed
the 2d day ofJuly,lB39.—Notice is hereby given.
"That every person.excepting the jasuces of the peace,
Who shall hold any office or appointment of profit, or
trust untie.. the United States, or of this Statc,or of any
c'lv or incorporated distnct, whether a copialissitoitst
off i cer or otherwise, a subordinate officer or - agent who
is, or shall be, employed under the legialptilis4- - -execuure

also, that every member of Congress, end of the State

ting to the elections of this commonwealth;'—passed
July 2d. 1839 (lather provides a. follows, to wit :
vThat the inspectors and ledges chosen as aforesaid,
shall meet at the respective places appointed for holding
the election in the district to which they respectively be
hang. before nine o'clock orate morning of the second
Tuesday of October in each and every year, and each of
said inspectors shall appoint one clerk, who shall be a
qualified voter of such district.
"In case the person who shall have received the second
highest number of votes for inspector, shall not attend out
the day of any election. then the person who shall have
received the second highest number of votes for judge
at the next preceding election, shall ct-is an inspector
in his place, and in case the person whir shall. have re
ceived the highest number of 'votes for inspector shall
not attend, the person elected judge 441 appoint an in
spector in his place; and in case the pin - nme elected'a
judge shall not attend. then the Inspector who received
the highest number of vote; shill appoint a judge in his
place; and .if any vacancy shall continue in the b..ard for
the space of use hour after the time fixed by law for the
opening of the election, the qualified voters of the town
ship, ward or district. for winch such officer shall have
been elected. mimetic at the place of election, shall elect
one of their number to till such vacatiey.".
"It shall be the duty of the several atisessors, respec-
tively, to attend at the place of holding every general, spe
cial or towashie election s , during the Wth•le time said e
lection :s kept open, for thepurpose ofgiving infdrtnation
to the inspi - tors and judge, when called on, in relation
to the right of any pertain assessed by them to vote at
' such election.or such other matters in relation to thess
sessment or voters as the said inspectors odge, or

"No person -shall be permitted to vote at any election
as aforesaid, other than a white freeman of the age of
twenty oneyears or mere, who shall have resided in this
state at least tine year. and in the etectibe district where
he offers to vole at least ten nays, immediately preceding
such election, stud willun two years paid a state or couu
ty tax, which shall have been assessed at least ten days
before the election. But-a citizen of the United Scales,
who had previously been a qualified voter of this state.
and removed therefrom and returned, end who shall hare
resided m the election district- and paid taxes, as afore
said, shall be entitled to vote after residing in thin state
six months: Provided. That the white freemen citizens
of the United States, between the ages of twenty-one sad
twenty-two years, and have resided in this state one year
en, in the election district ten days as aforesaid, shall be '
entitled to vote, although they shad not have paid taxes"
