A motion was made in arrest of judgment, and also for a neer trial, and reasons filed. Three eases were tricot ,by Bennett's conusel, and a fourth by other counsel. In alt those verdicts of " guilty" were rendered. The argument in one case applies to each, except a difference in the case of James Shannon, whit% will be noticed. Tho reasons on motion in arrest of judgment will be considered separately in the order in whioh they are filed. - The first reason is that the natio anoonstitation ol and void. The answer of the Court to this xenon is, that the act Is constitutional and valid. The second reason Is, that the first and second 'counts in the indictment are defective, tor they charge the offence disjunctively, and that the third count on the indictment does not charge any legal offence under the statute. The first count charges that " he did unlawfully keep and mointain a Untie, room, and place, where vin• Ode,' spirituous, malt and brewed liquors, or some admixtures thereof were sold and drank." The second count °barges that he did unlawfully keep for Bale, sell anti give vinous, spirituous, malt and brewed liquors, or some admixtures thereof, receiving therefor a price, profit and ad• vantage, and did then and there at the same time voluntarily afford a place, oonvenience and inducement by which the same was used as a beeerage, without having first obtained license agreeably to law for that purpose." The third count charges that "he did unlaw fully keep for sale and sell, vinous, spiritons, malt and brewed liquors and admixtures there of, receiving therefor a pries, profit and ad vantege, and did at the same time voluntarily afford a price and other convenience and in ducements, by which the same was used as a tevera ge" The first and second o mete on the indictment are drawn under the second section of the act, and the third count is drawn under the fourth section of the set, and is in the conjunctive. The offence charged is set forth in each count la the words of the act of assembly. It is alleged that the two first counts are de fective, inesmuch as they charge the ()fierce in the disjunctive. The words of the act is in the ditjanotive to Section second. Uit be put in the conjunctive , the letter and meaning of the act are departed from, and it will require proof of' two separate (deuces un der this ant, in order to movie on one. if it is an offence under this act to Bell the liquor raw, It Is au offence to sell it mixed, but if this objection to the indictment held good, then before there can be a conviction for selling raw liquor, the prosecution must prove that it was sold raw and mixed both, and before there can be a conviction for selling an " admixture," the Commonwealth must prove that it was sold without any admixture at all . The disjunction world be fatal as an objection if it described a; different offene•, but here it describes the same offence, kindred, perhaps identical, in Its character and embraced in the tame enter:toe of the mot of assembly, in the same Sentence of the act. What goes before the word or," might have been embraced in one count, what fo lows the word "or," might have been material for an other count. Suppose this had been done, aid one for selling an " admixture." Dee or the other would have been found true to a certainty, for this the jury has done, and the findieg of either, be it one count or two, is a complete offence and the deponent runs no risk of injustice. The form of the count is sast yeinad b prece dents of approved authority, framed to meet violations of laws against -ening without li cence, in violation of laws similar in their char acter and intention. Au indictment charging the larceny of a horse of a sorrel or bay " color, is good. The identity of a horse or man does not consist in the color of his hair, nor does'Spiriluous liquor lose its identity or effect by belief; Mixed with something else . It seems to me that if one half of the first and second counts were stricken cut as eurpluaage, enough would remain to make an offence under the statute, and that charges in those two COUD'e contain ample material for four . If there be one good count in an indictment, though others may be defective, a judgment on the indictment will stand. The jury have fiend every allegation in these indietmente true. But the third count is sufficient, independent of the rest. The objection urged against this count is, that it does not conclude without having first ;obtained laden se agreeably to claw for that purpose." This conclusion le in the second count, and it is enrplusage, and had the third count concluded in the same manner, a license under the Act of 14th April, 1855, would have been no defence ; - fora license would o , nfer WO Prit.bOrtly to "furnish, voluntarily to afford a place and other convenience and ucemeet by Which the same was need as a beverage The omission of this conclusion did not pre vent defendant from giving in evidence his beer license from the county, however, and the Court charged the jury that if he sold nothing but what he was licensed to sell, he must be acquit fed. );t was proved he sold brandy. The swarm of precedents of iedietmente which charge with "keeping tippling houses without license from the court," might, I think, be amended, for no court was ever empowered to license " tippling houses," but " taverns " The third exception, via : that no indictment or presentment was found by a grand jury for the offence which was tried, Is contradicted by the existence of the indictment. The fourth exception, that defendant was forced to plead without a responsible witnesson (horsed on the indiettment, is without force. The constable of the Ward was endorsed as prosecutor. It may be against the policy of the law to in flict the Costs of prosecution on a public officer, but a jury is not confined to the name of a prose cutor on an indictment. They are at liberty to find s prosecutor and punish one whose name does not appear at all. Or, they may say that the county pay the costa. The jury is not con fined to the indictment in finding a prosecutor. To say a constable is not a prosecutor, is to strike the law dead at a blow, for none other will appear as prosecutor under this sot. This law makes it the especial duty of the C o urt to see that constables make their returns, an d infliets a new and severe punishment on constables for neglect therein, It i s well ynown that no witness appeared in • any of these oases except on attachment, most of the witnesses took to the railroads; those who did appear, came by force, aud testified with .evident reluctance. a The fifth exception is a misapprehension, and an error in fact. To the sixth exception, it is sufficient to say, that though time and place muerte+ attached to every material fact averred, the time of commit ting an offence (except where the time enters into the nature of the offense) may be laid on any day previous to the finding of the bill, dote lag the period within which it may be prose. outed. The seventh exception is that the verdict of the jury was " without evidence" and " against evidence." This is a rash and reckless assertion. It wee proved in a manner apparent, transparent, clear and overwhelming, that each and every defend• ant kept hie grog shop in full blast, in open, wanton, end notorious violation of the law of the land, thus enjoying a monopoly of custom and profit, because others had ceteled to sell in obe dient:es to law, whilst these defied it. So far as regards the reasons for a new trial, they are all embraced in the reasons in arrest of judgment, which have been considered, noises it be some two or;three which are deemed insuf ficient and some of _these, as also io arrestof judgment, are erroneous ‘ ia point of fact. Now, how stand these oases on the merits ? Were the defendants sprang upon by some sud den and violent temptation which overpowered their love of law, bananas reibitance to tempta tion could begin? Certainly not. Their conduct was a calm, determined and de liberate violation and defiance of a law of the land, and a persietantie and continuance in an open contempt of the law, with their made,- standings enlightened and their eyes wide open; they knew the consequences, and they must take the.consequences. The law bais Pow been vindicated, and these oases being the hest under its provisions, the sentence will be light, and no precedent for sen tences in future eases. The motion and reasons for dew trial and in arrest of judgment, are overruled. After reading the shove document, his Honor proceeded to sentence each of the defendants— "to pay node of prosecution, a fine of $5O, and to undergo an imprisonment of five days injeil." The cells are clean and sweet, and so far as physical comfort is concerned Mr. Phillips will do all that law and humanity require to comfort the condition of those inearoerated, whose lot at best is by no means enviable.
