In addition to these a special reason was also filed in the case of James Shannon. Mr. Burke said that since the conviction of his client he had procured the deposition of Mr. James Mon tooth, which set forth that Solomon Salle, the principal witness of the prosecution, and upon whose evidence Mr. Shannon was convicted, vol untarily told him, previous to the trial, that he (8alla) did not see any liquor sold or drank on Shannon's premises. Mr. Burke also remarked that in case the Court saw fit to overrule thise reason, for ar rest of jedgmcit, he would respectfully present the following reasons why a 11011 trial should be granted : L.' REASONS POE A NEW TRIAL !-- I. Because the Court peremptorily charged r , the jury that they had no right to pass upon the P, law of the case, and that they were bound to l. take the law as laid down to them by the Court d 2. Because the Court peremptorily instructed 6 the jury that the provision of the act under r wh . oh the defendant was iudioted were entirely constitutional and valid. 8. Because (while the Court took the law of Lftho ease entirely from the jury) the Court en tirely omitted and neglected to charge the jury on the alleged legal insufficiency of any and all of the several counts of the indictment, although their attention had been directly called thereto by defendant's counsel. 4. Because the Court ohargel the jury that I the evidence of an offence committed by the de tend nt on the 13th of October, A. D. 1855, was sufficient to warrant his conviction, although the record showed that the information was made on the 11 of the same mouth; that a war runt was issued, and that the defendaut was ar rested on the same day; that the indictment was founded on the offence natal in said infor mation, and charged all the offences therein Stilted to have boon committed on that day, the 11 2d. lii After reading the above, the learned gentle man proceeded to argue, at considerable length, the various points laid down; and to maintain his position cited a great variety of authorities. Mr. Burke was replied to by II Biddle Rob ' arta, the district attorney, in an able and forci ble manner. Col. Black followed, on the same aide, the arguments being elosed by Mr. Loomis, for the defence. At the conclusion, Judge M'Clure took pas epsilon of the various papers, and said he would give itilil decision in a few days. DEBTRUCrrIVE FIRS.—On Saturday afternoon, about 6 o'clock, a fire broke out in the cellar of the extensive wholesale Drug Store of Schoen ! 7 maker & Co., on Wood street, between First and Second. Owing to the combustible nature of the articles with which the store was filled, the flames quiokly spread over the balance of the building, which, together with the valuable stook of Drugs, Paints, Chemicals, &0., was entirely destroyed. The fire also extended to the build ing adjacent, occupied by Messrs. Dawson, Now myer & Co., as a Shovel Warehouse., the two up per storiei of which were considerably damaged. The wholesale Drug Warehouse of Mr. George Newhouse, was also on fire several times, but was extinguished before much damage was done —they sustained oonsiderable I as, however, in the removal of their stock. Mr. Schoonmsker & Co.'s stock was valued at about $3 , 0;000, on which there was $2B 600 in ettraruf4 distributed in the following offices:— North American, $4,000 ; Reliance, $5.000 ; Mittens, $6,000; Western, $6,500 • Delaware Mutual, $5,000 ; Pittsburgh, $4,000. The building was owned by Mr. Sylvania(' La throp, and was not insured. His toes will prob ably be about $3,000. The loss of Dawson, Newmyer & Co., will reach $6,000 or $7,000, covered entirely by in- Stlttilleo. The establishment of Bogaley, Cosgrove & Co., wholesale grocers, adjoining the warehouse of the last named firm, was damaged considera bly by the fire. Their stock was oleo injured by water. The origin of the fire is not positively known ; but is supposed to have been caused by a boy drawing camphoric or turpentine in the oellar of Schoonmaker'e etoro, letting a lighted candle fall into the can which he woe filling.
