In the oases of the Commonwealth vs. John and James Wallace, and Commonwealth vs. Geo; King, cross suite for assault and battery, a ver dict of guilty was rendered against Jambe Wel lace and George Ming, each of whom were sen tenced to pay costs. Commonwealth vs. Patrick Creed ; indiptment,, Wawa and battery, on oath of Richard Cowie' ; Verdict of not guilty, and prosecutor sentenced to pay costs. Commonwealth vs. James John and Patrick Weich,_lndietment, assault and battery, en oath of Jeremiah M'Anemy. The Jury returned a verdict of guilty, and the defendants wore re niatiiled Commonwealth vs. David Robinson and Teets; indictment burglary. The - defendants were chargedd with breaking into the house of Mr. S. P. Shrivcr, in Allegheny, on the night of the 30th May, and stealing therefrom clothing to the amonfrots4o or $45. A portion of the clothing.was afterwards found in the possession of a Mr. M'Kee, who testified that he - purehased it from Jamul Graham. The prosecution offered Graham as-a witness, but he was objected to by f defence, on the grounds that he had pre viously been eionvieted of an Infamous offence, and sentenced to the Rouse of Refuge, whloh would disqualify him from testifying. The pro secution replied to this by exhibiting a pardon, aimed by the Governor, for the offence com plained of. The defence attempted to ahem that the pardon did not cover the offence, but Judge fil'Clure decided that this was immaterial, as It never was contemplated by the Legislature that boys sent to the Rouse of Refuge should ho dis qualified thereafter of their franchises. The witness was therefore allowed to be sworn. Ells testimony was to the effect that, In company with Teets, he entered the house of ShriVer, on the night mentioned,'and stole the articles des cribed in the indictment ; he entirely exculpated Robinson from any participation in the bcOglary. The jury, after a short absence, returned a Verdict of not guilty. Pra INIZTAL TIIIEVEIL—Three Irishmen, named Thomas Lieton, Maisel Wade and John Wiston, were committed to jail, yesterday, by Alderman Backmakter, for stealing several hundred Sunda of pig metal belonging to Mr. Robinson. The pig metal - was taken from the wharf; and was found secreted in the house of one of the Listens, in Miltmberger's alley. Warrants were also issalid for the arrest of Margaret O'Rourke and Michael Liston, charged with being conoorned, in the same robbery. Two Maw DROWNED.—Two men named Bam. B. ,170111 e and 811,4, were drowned near,Shouse; town; ;pout twelve miles below this city, in the Ohio river. They were ferrying some cattle across the river in a flat, when the animals be came excited, and all ran towards one end of the boat, ceasing It to sink.
