the Steamship Vnole Sam, of the Panama line,
lost-on her recent passage from Panama to San
FranCisco, one hundred and six passengers !
They were mostly steerage passengers—the ex
ceptions being three of the crew and nine pas
eengers. The cause of this great mortality it;
attributed to the fact that the steerage passen
gers ate freely' of green plaintalne, bananas,
and all the unripe fruits with which the Isthmus
abounds ; drinking also large quantities of lime
juice, lemonade, etc. The cabin passengers
-generally had sufficient judgment to atettain from
eating such trash, which probably accounts for
their exemption from disease.

Judge Kane delivered an opinion on Friday
morning adversely to the reception of the peti
tion of Jane Johnson, to quash the writ of habeas
corpus in the case of Fenimore Williamson, pro
nouncing her to have no stains in Court, being
entirely without its jurisdiction. The opinion
'is very elaborate, reviewing the whole case and
reaffirming his former opinion. Ho assorted
that the law of nations guaranteed the right of
transit of Mares, and of every other species of
property through territory where slavery was
not recognized. If the oontrary opinion was
Batiatiened, the time might come when the cot
ton of Louisiana, the rico of Carolina, and the
rum of New England would be restricted from
transportation, without the bounds of the State
producing them. Ho maintained that the Fed
eral Constitution recognized slaver as property ;
and up to 1830, slavery existed in the original
thirteen States. He said that Williamson's
duty, then, tie bow, was to produce Jane John
son's children. Were the petitioner here to
abide the action of the Court, she would have a
right to be heard; but being without the Junin
diction, the records of the Court cannot be
opened for a stranger.
On the conclusion of the delivery of this
opinion, John Cadwallader, (a member of the
bar, but not engaged in this care,) in order to
remove a false impression from the public mind
said, from his recollection of the circumstances
attending the commitment of Passmore William
son, a proposition was made to amend the return
to the writ, when Judge Kane replied, "I will
not receive an amendment now, but will be pre
pared to receive it when the record has been
completed." No such motion was subsequently
made, and the public impression that permission
to amend was refused, is not warranted by facts.
Judge Kane replied that his (Mr. Cadwalla
der'e) impression was correct. He had been
prepared to receive a supplementary return
from Mr. Williamson ' s co unsel, but none had
been offered.
Mr. Cadwallader suggested that an addition
be made to the opinion of the Court, em bracing
the remarks of a member of the bar not engaged
in the case, and the reply of the Judge. Ile
was induced to make the suggestion by the best
feeling towards a worthy, but mistaken man,
'Lupins It might lead to the adoption of such a
course as would end in hie liberation.
Mr. Cadwallader le to embody the remarks he
made, when the Judge will follow with his an
swer, so as to complete the record.

he had listened with attention to the opinion,
