District Coort—Continuation op the Small
Note Suits.—The suit against the Ohio and
Pennsylvania Railroad Company, for passing
small notes, was continued yesterday morning
before Judge Williams.
: i Mr. Hamilton, counsel for plaintiff, requested
the Courtto note ‘that, in connection with the
deposition of Morris, they offered the notes
therein Identified.
The prosecutor, Mr. D. T. Lawson, was called
to the Btand,:to testiy as a witness.
The withess was pt.jeoted to by Mr. Courtney,
on-the grounds of Inoompetency, ho baring heen
contlotedof a serious offence.
' ihis objection was sustained by the Court
• Ihe plaintiffs then ML'eA in <mdeuco a pari
don granted by Governor Bigler, to Lawson.
The sanja objections weremsto to this pardon,
aa stated yeßiefdaylo regarsTto the pardon of
Morris.
The Court orerruled the objections, and allow
ed the pardon to be offered.
D. T. Lawson was then sworn.' The plaintiffs
deßired to show by him that the notes on which
the Baits were brought had been issued by con
ductors and tiohet agents of tho Compaoy.
This was objeoted to by Mr. Williams, as it
was net Intended to be shown that their agents
were authorized by the Company to pass the
notes referred to.
Mr. Hamilton was of the opinion this was odo
of the mast important points raised in this court
for many years, and desired that another time
be made for arguing it.
Mr. Williams said tho Court could decide the
case now as well as at any other time.
The Court decided to hear tho arguments.
Mr. Williams then proceeded to argne the
qaeslion at considerable length. He said no not
of an agent conld render a principal responsible
for the commission of a oriminal set. The em
ployers themselves must commit the act, before
the; conld be held. H this principle was not
correct, the whole capital of tho Company might
be absorbed in a short time Two thousand
such salts, probably, might be instituted every
day,- which, if they were deoided against the
Company, would consume the whole stock of the
corporation. The caso turned upon the question
Whether the agents passed these notes as spocial
agents, end by authority of the Company. Mr,
Williams substantiated bis position by reference
to a large numbpr of authorities.
On the conclusion of Mr. Williams’ argument,
Mr. Hamilton staled that tho witaess, in addi
tion to proving what he previously stated, would
testify that-the Ohio and Pennsylvania Railroad
Company, through their ticket agents and con
ductors, were in the constant habit of paying
out small notes, prior to the institution of these
suits. Mr. Hamilton further remarked that he
would not argue the question, but leave it to
the decision of the Court.
Judgo Williams remarked that although he
would have preferred having the question argued
on tooth Sideg, In order to give him more time
for consideration, the impression on his mind
was favorable to tbe objections, which were,
therefore, sustained, and tho witness ruled ont.
The Court then remarked to tho jury, that as
no evidenoo bad been allowed to go before them,
they wonld of course render a verdiot for do
fardsnts.
ThU‘ action ends the matter for tho present.
A writ of error wilt be tatoen-ont by the plain
tiffs, and the caso carried up to the Supremo
Court. *

The arguments ip this case were continoed dar
ing the morning, and tbe case went to the jury
about 11 o'clock. After a short absence they re
turned into Court, with a verdict of "guilty.”
Commonwealth vs. John Hartman; indictment,
nuisance, in keeping ferociona doga, on oath of
Henry Bagebruck. The defendant, in this ease,
ia the owner of the dogs who attacked and fright
felly lacerated the wife of proaeontor, a few
weeks ago. He resides np Batcher’s ran, Alle
gheny. Verdict of gailty. The prisoner was
remanded into the custody of the Sheriff.
Tbeatbe. —Shakspeare's great tragedy, Mao
beth, was played last night to a fair hoase, and
with a Bomewbat better east than at its enact
ment a few weeks since. Mr. Conldook, as the
chief hero of the piece, showed unmistakable
power of genlas; it is not, however, his best
Shakeperean character. He plays King Lear
to night, in whioh we think be is infinitely bet
ter. By the fcw, there is some talk of getting
him np a complimentary benefit. We hope the
projectors of it may aucceod in their design, for
there is no man who performs on our boards
who is so asßiduona in bis efforts to give satis
faction to our theatre-going people.
Democuatjo Cotjhtt Convention. — The dele
gates eleoted at tho late Democratic primary
meetings, will assemble this morning, at ten
o’clook, in tho Court House, where they will
select delegates to represent the Demooracy of
Allegheny county in the ensuing State Conven
tion.
