Neely. jAegument poe a New Trial.— The motion to gwint a new trial in the case of J, W. and J. •*Bfad4ey, Win. Graham and Thomas Stewart, convicted of malicious mischief, was argued on Saturday morning before Judge M’Cfore, by Col Wilson M’Can'ilefcd and Mr. Frew, the pri soners* counsel. The grouuds upon'which the now trial is asked, are that the Oonrt indicated too strongly its opinion of the evidence, and that the verdiot, iu a measure, was given under constraint. The counsel said that after the case had gone to the jury, they came down from their room unable to agree. The Court had sent them back with the assertion that the case was as‘“apparent, transparent and clear” as could be, ttad that they must agree. Under this posi tive order the jury, that they might get to their homes, had rendered a verdict of guilty. The gentlemen argued that the Court had exceeded its privileges in giving such an opinion, and fhgitAhc defendants were entitled to a new trial off those grounds. The argumeut was quite lengthy, and at its close Judge M’Clnre said he WOuld-Tchder his decision ia a few days. District Court.— Before lion. IT. W.
