The Court of Quarter Sessions, yesterday mor
ning, according to notice previously given, com*
menosd the disposal of the Baptist Church oases.
By an agreement between the counsel of both
parties, the whole number of cases, seven in
number, were ordered to be tried by one jnry.
Thta will save a considerable amount of oostSi
and expedite the business.
The indietments, as handed in by the proseeu*
ting attorney, B. Biddle Roberta, are as fol
lows:
Commonwealth vs. John Follansbee, John Van*
dergriff, Arthur H. McClelland, John Soannell,
Aquilla Soannell, Drs. J. P. and W. H. Dako, et
cL Indictment, unlawful assemblage aud as
sault and battery, on oath of Rev. Samuel Wil
liams.
Commonwealth vs. Rev. Samuel Williams.
Indictment, assault aud battery, oo oaths of
Aquilla Soannell, Joho Follansbee, and John
Vandergri J.
Commonwealth vs, John Vandergriff, John
Follansbee, A. H. M’Clellaad, Wm. H. Bake and
Aquilla Scanlon. Indictment, assault and bat
tery, on oath of Samuel Williams.
Commonwealth vs. John Follansbee and A. H.
M’Cleliand. Indictment, assault and battery,
on oath of Samuel Burgesser.
Commonwealth vs. Samuel Williams, Samuel
Burgesser aud Emly Beauford. Indictment, as
sault and battery, on oath John Vandergriff.
These suits all originated and were caused by
a difficulty which oocurred at a church meeting
of the First Baptist Church, of which Rev. S.
Williams is pastor, held on the 29th of Joly last
For some time previous to that date, a dissatis
faction had existed in the congregation, in regard
to their preaeher, which finally resulted in a j or
tiou of the members holding a meeting, deposing
Mr. Williams, and electing a new board of trus
tees. The balance of the congregation, aud the
old trustees, however, did not recognise .the le
gality of this action, and continued Mr. Wil
liams in his duties as minister of the church.
This, of course, created two different parties, or
factions, in the ehurch, each striving for the
nuetery. On the evening of the 29th July, a
meeting of the congregation was held at the
church ; of which, Rev. Mr. Williams acted as
moderator. Bome objection was made by the
party opposed to the minister, to Samuel Bar
gosser acting as Secretary, and a motion was
made by Mr. M’Cleliand to remove him, to give
place to Mr. Scanneli. This motion, the modera
tor refused to put to tbs meeting, and a general
row ensued immediately after. The opposition
party endeavored to secure possession of the
minuts book, whilst the ministers! party tried
as strenuously to prevent them. In the scuffle,
the Pastor put out the gas light above the pu •
pit. Mr. Burgoaser, the clerk, was seized by
Messrs. Follansbee and M’Cleliand who, in tbeir
attempts to wrest the minute book from him,
pushed him back agaiust a pew, and threw him
on the floor. In the struggle, the anti-William*
party sueceded in getting the book. After lb*
melee had .lasted a few minutes, Mr. Williams left
the room, and went down to ’Squire Steel’s, and
made information against the several defendant*
as above enumerated. The next day, the other
party also laid similar charges against Mr. Wil
liams and his backers.
An attempt waa made on Tuesday night to
have the auita compromised, by each party"pay
ing their own coeta, but the plan waa not acced
ed to by the counsel for the Williams party.
After spending considerable time In empanel
ling a jury, the case was opened for the Com
monwealth by R. Biddle Roberts, Prosecuting
Attorney.
The first witness oaßad was tbe Rev. Mr.
Williams, who ocoupied nearly the whole dny in
delivering his testimony. Mr. Williams was fol
lowed by Samuoi Burgosser, who occupied the
'balanoe of the day.
Messrs. Kirkpatrick, .Marshall and Darragh
appeared for the ministerial party ; and Messrs,
Black and Hasbrouek for the opposition.
Prom the array of talent on both sides, great
speeches may be expected, when the coonsd
commenoe their arguments.
District Court.-— Before Hon. M. Hampton.
Wrdksbday, November 15.
Lynch and Haney vs. Smith. This is an ac
tion in which tbe plaintiffs claim $385 for
damages, on accoant of several rafts of lumber
sold by the defendant to plaintiffs for a full
price. Plaintiffs alleged that there was a large
amount of rotten aod damaged timber carefully
concealed, for the porpose of deceiving tbe pur
chasers. The defendant denies that ho had any
knowledge of tbe defects in the timber, having
bought tbe rafts from a man named Bosh, who
had, as testified by one witness, designedly so
oonstrnoted the raft as to conceal the bad logs.
Verdict for plaintiffs for $B5 50.
M'Candless vs. Moreland. Rule for judg
ment, for want of a sufficient affidavit of defence.
In the case of A Kirk Lewis ve. Irons, the
plaintiff moved for a new trial.
Lee vs. Schoeffle. Rule to show cause why
judgment should not bo set aside, aod in the
meantime proceedings stayed.
Bimpson vs. A. A. Mason. This is an action
covenant on a .lease of the store room for
merly occupied by the defendant on Market
ntreet, in this oity, in which tbe plaintiff olaims
a balance of rent due. The defendant alleges
that the rent was paid in repairs made by him
on the premises. To this tbe plaintiff objects
that the repairs were so badly done aa to be of
no value. No verdict.
Th« New Play of “Clara,” The distin
guished and popular actress, Miss Kimberly, we
are glad to see, is drawing full and fashionable
houses at the Theatre. This evening she pre
sents a new play, written expressly for her, enti
tled “ Clara—tbe Christian Heroine.” It ie eaid
to be an exceedingly interesting play-inculca
ting the highest moral, viz: filial dniy—and por
traying, in tbe most vivid light, the power which
avarioe bas over the human mind. From a
lengthy notice in a Boston paper we gather that
the plot is of stirring effect—the interest in tbe :
play being folly kept up from the beginning to
the end. One aot cannot be seen withoot creat
ing aft intense desire to see the next, and so on
until the play is finished. We may safely look ,
for a crowded house.
•Riot — Three persons, named Alex. Forsyth*
John M’Lean and Matthew Coward, were yes
terday taken before Mayor Vols, for riotous
and disorderly condnct. It appears that these
. three persons, along with another man named
Wm. Irwin, were all out on a drunken spree, in
tbe Eighth Ward, and coming across George
fitroble, a farmer, from Pitt township, abased
and beat him in the most brutal manner. Two
watchmen, who attempted to arrest them, were
also injured badly, and it was only after a large
police foree was called, that they were finally
Beenred. Forsyth and M’Lean, in default of
$2,000 bail, were oommitted to prison. Coward
wae released on giving security in $l,OOO. The
other person haa not yet been arreated.
Frisch Emigrants.—Wp observed, jester
flVv'.P* Captain Marsh’s new steamboat, the
oe*on Wave, a party of Frenoh emigrants, who
leave- this morning for tbe Icari&n oommnnity at
Nauvoo, Illinois. They are direct from France,
and under the charge of an agent This makes
the third or fourth party who have passed
through this city lately, to settle in the “ City of
the Mormon Prophet.”
Fir* ih M’Kkbsport.—We learn that the
dwelling house of Mr. R berte, in McKeesport
one of the best in the borough—was partly
destroyed by fire, on Tuesday night. The build
ing coet $5,000. Tho damage is estimated at
wibost $l,lOO. The. loss is more than oovered
ty on insurance of $2,400.
Arrested.— Two men, namod Edmund Fre
•deser and Augustus Meyers, were arrested yes
terday, by officer Fox, for stealing several tranks
from the Excelsior Omnibus depot. They were
committed to jail by Alderman Major, to await a
further examination to-day.
Bask Closed. —A telegraphic, despatch ar
rived in this city yesterday, announcing that the
Mechanic’s and Trader’s Branch Bank, of the
State Bank of Ohio, have closed their doors-

steamer, drawn tip to the wharf yesterday afternoon. Bbe

tively leave to-day for St. Louis and porta above.
The “Ben Franklin” leave* for Cincinnati and New

Commonwealth, and to regulate certain Judicial Districts
It Is enacted and provided as follows, tls: Section 9, That
on the Fint Tuesday in November next following any elec,
tlon anthorli.il by this act, the Secretary or the CVnnoon
wealth shall, tu the Hal! of Kepmeutatlrae, in the pres
ence of the Governor, and such other rillsen* of this Com
monwealth as may choose to attend, cause the returns made
to him, under the provisions hermf, to be opened, and the
votos cast for Judges of the HupremeCourt to be accurately
computed, and the Governor shall forthwith issue his pro
clamation, declaring «o many of Hie pc sons voted for, for
Judges of the Hup rente Court as shall l*» required to bo
elected by this art, and who has received the greatest nam
her of votes, to he duly elected.
And, Whereas, The Secretary of the Commonwealth did,,
at tho time and place, and In the manner provided by thv
act aforesaid, cause the returns of th« election made to him'
to be opened, and the vote* cast for Judges of the Supreme
Court to be accurately computed.
Now, therefore, in obedience to the requirements of the
above ninth section of the Act of the General Assembly
aforesaid, 1 do hereby issue this Proclamation, publishing
and declaring that of the persons voted for, for Jadgn of
the Supreme Court of this Commonwealth, at the late Gen
eral Election, held on the Second Tuesday of October last,
