was an action for damages dono to a house, on Second street,
In this city, bv excavations made in a lot belonging to tho
: defendants. The foundation walls, ll was contended, were
undermined, and tho walls of the house cracked in conse*
quenco. A verdict was returned for defendant ’
White, Owens and Ross Belts; No. 472,. November
term, 1852, Haabrouck for plaintiff, and Barton for defend
ant - This was. an action on a book account, for lumber sold
and delivered. Tho defendant contended part payment and.

; Bench Warrant Case.— Poter Cavanaugh was arrested
yesterday, on a bench warrant issued, by Judge Shannon;
and taken before his Honor, Judgo 8., at the suit of Mary
. Cavenangh. hln sister. She charges him with seoretingand
disposing of his pmpeyty for the purpose of defrauding her
of (468, to which she is entitled. Miss Cavanaugh recov
ered tho. sum mentioned in a rocont suit in the District
Court, for services rendered her brother as house-keeper,
- and she now represents that he is taking measures to avoid
the.payment. The hearing of tho care waa adjourned until
Wednesday,Caronaugh having given bail for his appearance

. Railroad CoiLisiON.-^On; Saturday evening, the Exprer*
train of the Ohio and Pennsylvania railroad was detained
about an hour over its canal tlmo.iu consequence of tho
train eastward coming in collision with the Mall train at the
switch in Clinton, beyond Wooster. The engine --of the
firmer train ran into tho hind oar of the latter, which
threw It off the track and slightly damaged tlio-locomotive.
Kb person was lojnred. ’The ear was replaced on tho track
without sustaining any Injury* and both trains started on

of a German named Bllpe, a resident of Mount Washington,
was burned to death, in tho absence of hi? parents from
- home.-'The mother of tho lad was at chorch, and tho fath
er, who is a carter, had gone out to his horses: in. their ab*
mocks it Is supposed the child left it* b**d, and that its night
rlnthoa took fire from a csndlo which It attempted to light.
• When the father and mother returned, the child was dead,
its clothes haring caught fire; the body wna horribly burn*

Suicide —A young man named John Boyne, committed
suicide on Thursday night Inst, at tho residence of his
father, in Pine township, bvcnttlnghlithroatwltii a razor.
Ho was in the habit of drinking, and hnd become deranged
for a fow days previous. When ho wasdlscovercd on Friday
morning, his head wasneariy severed from his fehoulder*. ’

Teenhooven. with tho larceny of a dress valued at throe
dollars. Anna was arrested and hold to answer the charge
of larceny.
Riotous.— A msn named Jacob Hanly, of the Third
Ward, Allegheny City, was arrested yesterday, nod taken
before Mavor Pork, charged with riotous conduct on Bun
| ’ day. His Honor fined him fire dollars, on tho payment of
which he was discharged.
