they-do not suppose that because ho speaks it
Very imperfectly, that they aro under any obli
gation to abandon it in the schools merely to
gratify his dialect.
Illis.insinuation that the feelings of the editor
of the Poit are hostile to our Gorman fellow -
citizens, is an idea that could only originate in
the mind of the editor of the Courser. Why, we
'ere known to the (lemma of Pittsburgh, and
enjoyed their friendship, long before ho made
his appearance among us. Ms say-so cannot
place the editor of the Post in a wrong position.
We care not for all the Irish he may bring against
us. We like it. A cross of the Irish never hurt
any man; but if his temper indicates the feel
ings-of his countrymen (Lord only knows where
that country is,) we would pray most devoutly
for protection.
We hope the editor of the Courier is' satisfied
by this time that it is folly for him or any other
adopted citizen to attempt to change the order
of things in the United States. We have our
own form of government, our own laws, and un
der these he enjoys more privileges than ever he
or his ancestors did in their servile positions un
der the monarchies of Europe. Too much free
dom has made him insolent: and while he is in
capable of appreciating the favors granted him,
he understands that his currish nature has per
mission here to send forth the growls that he
dared not have uttered in the land from whence
he came.
He affects to be a democratic editor; and tl o
democrats of Allegheny who have had dealints
with him, can tell bow much sincerity is in his
profession. But we have said enough about him.

Tn STEAMBOAT MEN ANI, THE MERCVANTS.-
We find the following remarks upon the Bill
of Lading which was recently published in
our paper, in the Cincinnati Price Courant of
the '36th :
The above would deprive the shipper: of every
advantage, arid would leave him entirely at the
mercy of the carrier. It would be no easy mat
ter fora skipper to prove that every lost or darn
age resulted fraud or by carelessness, although
finch might be the fact. If shippers could travel
with their goods, and keep a constant w•.stch over
them, they might possibly be able, in case of
loss or damage, to produce the necessary proof.
As might be expected, the Merchants of Pitts
burgh have protested against this mcrvement,
and pledge themselves not to ship their mer
ohandizo on any boat insisting on such n Bill of
Lading.
We do not know what the laws of Pennsylva
nia are with reference to Public Carriers: but in
Ohio we have, law governing the matter which
would render a contract similar to the above of
no effect.
We have seen letters, from Pittishurgh, which
state that the Cincinnati Steamb , mt Owners have
in view a similar arrangement. We have the
best authority for stating that such is not the
case. An Association has been formed here ,
but this Association has not for its object the
regulation of freights, or any form of contracts.
It was proposed to adopt a 13iIl of lading ; and
the above form was introduced ; but the propo
sition was not sustained by even a respectable
minority.
Wm. 13. Cassilly, Esq., is Presi:dent of this
Association, and as this genelemas, is non-lent
ingly opposed to the Board of Underwriters,
similar to which, in principle, is the combina
tion of Pittsburgh Steamboat intot este, the es
tablishment of a monopoly by the Steamboat
owners of Cincinnati need not be apprehended
while he maintains his present pt.sition in the
Association.
Pittsburgh need nor, therefore, look for " aid
and comfort" from Cincinnati in their attempt
to establish a monopoly which, if carried out,
would prove to be one of a most oditts character.
Tau contributions forwarded from this city,
to New Orleans by the Odd Fellows alone, in aid
of the sufferers, by the late prerail3ng epidemic,
in that city, amounted to $3OO. The receipt of
the money has been acknowledged by Mr. Tur
neanx, Secretary of the General Relief Commit.
tee, in two letters, dated the 21st September,
and October G. The lettere are published in the

Mr. J. ROLAND STEWART, who graduated at our
Institution. August, 1852, and has been teaching
in Jefferson College, Miss., where he died on the

If the law which regulates the selection of ju
rors be violated, the party in danger of being In
jured by it, may challenge the array for Chat
cause, and refuse to be tried except by a legal
jury, but he waives the irregularity if he goes to
trial without objection.
-I. The fourth specification asserts, that the
attorney for the Commonwealth challenged five
jurors, and that they were set aside without the
consent of the prisoner. By the record it appears
that these jurors were challenged for cause.
It i, not denied, that the right of the Common
to challenge a juror for cause, is 11.4 clear

We presume nothing against a prisoner in the
condition of the unfortunate 111:LI) now before us,
except what the record proves affirmatively.
Because therefore it does not appear that the
two jurors referred to were called after the ex
haiastiou of the regular panel, and upon an order
of the Court for talesmen, we are bound to say
an irregularity was committed.
But agreeably to the act of 1814, already
oiled, it was cured by a trial on the merits It
was an " error or defect in the summoning" of
two jurors, and is within the letter and spirit of
the statute. It was the prisoner's duty to make
this objection when the jurors were called, and
not having done so, it is forever too late.
9. The record does not in the body of it state
the names of the witnesses who were summoned
for and against the prisoner. But on the mar
gin of the minutes the names are noted, with the
addition of the word •sworn," to each name.
We are of opinion that the specification of
error founded on this fact, cannot be sustained
for two rtirisons, either of which would be suffi
cient, without the other.
In the first place, it is not necessary that the
names of the witnesses should appear on the
record, any more than it is that the evidence
should be set forth.
And secondly, if it were necessary, their names
are here. It is sufficiently apparent that they
were sworn according to law, for when a witness
is said to he sworn, it must be intended that he
was legally qualified to give testimony.
I I. The last specification is, that the prisoner
does not appear to have been present during the
whole trial. The record shows that be was pre
sent during every stage of the proceedings down
to the time when the verdict was rendered; that be
was also there when the motion for a now trial
was argued, and when judgment of death was
pronounced' upon him. Rat he was not there
when the motion for a new trial was made, nor
when the time was extended for filing reasons,
nor when the reasons were filed, and a day fixed
for hearing the argument upon them. We are of
opinion that the presence of a prisoner charged
with a capital offence, is at any time between
the verdict and sentence, though very proper,
not necessary to the validity of the judgment.
Ills counsel may ask for a new trial in his ab
sence. But if we thought this exception sus
tainable, the prisoner would not be helped by it.
It relates to a part of the case which comes af-
ter the verdict, and at worst it oould not do more
than vitiate the sentence Looking at it in that
light, it would be our duty to sentence him anew,
or perhaps reverse the sentence, and remit the
record with directions to proceed according to
law, beginning at the point where the error was
committed. But the granting or refusing of a
new trial is purely discretionary, and nothing
connected with the manner of its refusal can be
the subject of error here.
The loose manner in which records are kept
in Pennsylvania, makes it necessary that we
should consider every thing found in the office
of the clerk, and relating to the case, a part of
it, whether it be entered on the docket, or on
the minutes, or in separate papers. We have
no other record, than what can be made up in
this way, by combining every thing together.
We cannot reject an entry on the minutes any
more than a docket entry. We have therefore
considered the minutes as a part of the record.
We have examined all these exoeptions care
fully. We have not for a moment forgotten that
the life of a human being hangs upon our decis
ion. But we are all of one mind, that the pris
oner's case is beyond our reach. We can give
him no relief without violating those laws which
we are here to guard and defend. If wo could set
aside the judgment, for such reasons as he has
presented, we would render justice impossible
in many cases, and expose society unproteoted
to the danger l

Tile GUANO NIONOPOLY.—It is stated that a
powerful organized effort is in progress at Wash
ington to induce President Pierce to undertake
such vigorous measures as will break the Peru
guano monopoly, and throw open the trade to
American enterprise. Various agricultural so
cieties have sent committees to visit the Presi
dent for this purpose ; and it is said that the
President, feeling the Importance of the Subject
to. our agriculturalists, has determined to open
negotiations with-. Peru in reference to it.
. The yield of the potato on the American hot
tom, near Alton, Illinois, is perfeotly astonish
ing. As many as four hundred bushels per sere
have been dug. The average is three hummed
bushels. They are worth 25 to 80 cents per
bushel.

Mr J R Brodhead, who has been appointed
Naval Officer in New York, is the author of a
History of New York tinder the Dutch Govorn
meat, of which one volume has been published.
He is better known in literary than in political
circles.
Never was game, says the Winchester (Va.)
Republican, more abundant than at the present
season. In the fields and woods patridges,
pheasants, turkeys, squirrels and the like are
found in great numbers.
The schooner ern., loaded with 340 tune of
railroad iron for the Ohio and Indiana Railroad,
was sunk in the Cuyahoga last Saturday, by be
ing snagged upon one of the piers of the new
bridge. She lice above the proposed bridge, in
about ten feet water. Boat and iron will be
raised soon.
The Commissioner of the Land Office has is
sued a circular, embracing detailed instructions
respecting surveying lands, granting pre-emption
rights, &c., in California, very important to set
tlers in that State.
The Louisville Journal hears of a contract of
between 1,000 and 1,400 head of bogs, in Hardin
county, Ky., to average2oo lbs net, and to be de
livered about the middle of December, at 80
per cent. net.
The Big Sandy News says a vein of Cannel
coal has been disoovered on the Big Sandy, six
teen miles from the Ohio. The strata is four
feet thick, and the samples the editor had aeon
were of excellent quality. A vein of bituminous
coal, three and a half feet thick, has been opened
on the Big Sandy.
Mr. and Mrs. Barney Williams are at present
performing a brilliant engagement at the Walnut
street theatre, Philadelphia. They will shortly
appear in Baltimore.
The wood-limners at Winchester, Va. have re
solved to haul no more wood to that town after
the let of November, unless the corporation re
peals an ordinance lately passed for the inspec
tion of wood.
Messrs. Diego, of Havana, who lately failed
for $1,700,000, it is said, have offered to pay
their creditors at the rate of $l6OO, per annum,
with interest at six per cent.
The Camonches are again committing devasta
tions in %Vet:tern Texas, wherever the U. Staten
troops happen to be absent. A party of them,
on the 29th ult., made a descent on the settle
ments eight miles above Helton, and stole twen
ty-five horses, with which they decamped. A
party of fifteen volunteers started in pursuit of
them.
Robert W. Johnson, late member of the U. S
House of Representatives, has been appointed
by the Governor of Arkansas to fill the vacancy
in the U. 8. Senate, caused by the resignation
of the Hon. Solon Borland, now filling a diplo
matic station.
It is stated that certain capitalists have pur
chased some eleven hundred acres of land Just
below the anyandotte river, in Virginia, for
which they pay $BB,OOO. They contemplate lay
ing a portion of this tract in town lots, which are
expected to sell well and readily, Guyandotte be
ing the focus of a grand system of railroads.
Geo. W. Clinton, Esq., the "hard shell" can
didate for the otTioe of Secretary of State in N.
York, closed his speech in the Park on Monday
evening, by expressing the hope " that the glo
rious confederacy shall cover not only this Con
tinent, but the isles of the sea, and Cubs, and
Ireland 'hall be embraced in our arms."
The Cincinnati Columbian says:—Within the
last three months there has sprang up, in this
city, a now seoret order, under the nomencla
ture of the " Family Compact" Tho order is
open to females as well as for males: it is for
beneficial and charitable purposes and already
numbers about five hundred members in this
city.
The late heavy Northwest gale has extended a
great distance along the coast, and no doubt done
immense damage to the shipping. The Charles
ton nod Savannah papers received yesterday,
mention numerous disasters, almost every vessel
arriving at those ports showing the effeote of
the storm, and bring accounts of damage done to
other vessels passed at sea.
DEATH or TOE SLEEPING MAN.—Cornelius
Vrooman, who had been asleep fire years, died
at his brother's residence, in Clarkson, N. Y.,
on the lab inst. While on exhibition in New
York, he was taken sick, which seemed to induce
a wakeful state for a short period, and then a
stupid condition, with intervals of wakefulness,,
until he was brought home on the 14th. It is
stated that he talked very little, inquiring after
his mother, who had been dead two years, hie
father and brothers, whom he seemed partially
to recognise. He complained of great internal
boat, and soreness of his throat and stomach.
On the morning of the day of his death he called
for food, and ate a hearty meal, and then from
that time he seemed to be in pain until about 2
o'clock, P. M., when he died without a struggle.
His age was 34 years.

worth a million dollars, on the west branch of
the Penobscot, Me., which cannot be got down,
in consequence of the want of water. There are
also about 150 rafts, making 20 cargoes, from
five to ten miles above the city of Bangor, wait

The demand for lumber is great, and cannot be
supplied. What there is in market commands a
high price. •The export of long lumber from
Bangor this year stated at 2,000,000 feet; of
short lumber 160,000.

AFFELAT AND DEATIL—The lose of human life
in the public streets, by the, hand of violence is
a matter of too frequent occurrence to excite
much interest or surprise. An affray, which
originated. simply enonth, In a few angry
words, in Brooklyn last Sunday morning. ter
minated in two or three minutes, by a bloody
death. It was a painful 1,16/eau. Six young
men with flushed and passion-distorted faces en.
gage in a wordy combat; four are standing at a
street corner, and two are passing along the
sidewalk, when an Insulting remark provokes an
abusive rejoinder--there is a scuffle—two forms
are rolling on the ground—in a moment there is
a hurried flight—a ghastly corpse is lying on the
pavement ; and beside it a bloody dirk, with
blade seven Inches long
The parties under arrest for this murder—
Morse and Doi:loran—are both young men, nei
ther of them being over twenty-two or twenty
three years of age, and are clerks—the former
in the apothecary store of Joseph E. Trippo,
Maiden-lane, and the latter in the real estate
office of Gustavus A. Bradbrook, Broadway, New
York. They went on Saturday evening, accord
ing to their own story, to the meeting of an as
sociation in New York, of which both are mem
bers—known as the " Shakspeare Dramatic As
sociation," and upon their return home late at
night, under the influence of liquor, at the place
mentioned above, they were attaoked by by the
parties named, and that the knife was need in
self defence. Morse says that he purchased the
dirk to use on the stage, and be bad taken it
from the rooms of the Association to exchange
it for one more suitable to the purpose.
The affray took place near the boarding house
of the murdered man, Neil McCue, and after he
was stabbed he ran as far as the door, a distance
of about twenty feet, when he dropped dead.
