• Habeas Corp rui.--ra case of habeas corpus came
. tip this morning in the Circuit. Court or the Ifni
. • ted States, before his Minor Judge Irwin.
.• '• • The eel:dors were Edward'. Jones and John
-Ifarpier, of Louisiana, who- had been committed
to jail on Saturday by process of the Circuit
Court; on - the affidavit &c. of Dan Rice. It ap
pears that Herpier - and Jones, equestrians and
gymnicks, IYer() employed last winter in New
Orleans, as performers - in Rice's -circus, at a
pretty high salary. The other Tacts in connec
tion with the case we did not exactly learn. The
affidavit, however, alleged fraud.
Several points arose undei the act of Congress
• of 1839, the Pennsylvania statute of July, 1842,
and the laws of Louisiana. P. C. Shannon, Esq.,
- - counsel for Rice and Whitbeck, argued that the
jurisdietion , was ;undoubted, and the affidavit
sufficient to warrant the Court to hold the relit
- tars to hail or to remand them to prison. He
contended that fraud might arise during the ex
- istence," or hi .the course of . o contract—that
.
whilst an allegation of fraud in the inception of a
contract -was one ground upon • which an arrest
could clearly . be made under the statute of 1842,
yet that was not the only.caso contemplated by
that act. If it were, then all - frauds perpetrated
• daring the' various. stages of contracts, which
oftentimes required years to consummate their
provisions; and were frequently matters of slow
progression, ' were beyond reach of adequate
remedy in such-instances as the present, and
would.be committed with impunity. He further
argued that the gist of these actions was tort,
and that' even in the -State Courts, under the
facts now before this tribunal, a copies might
properly issue. As-to the point made by the
learned counset(llr. Hamilton)' as . to whether it
was lawful for an agent to make the affidavit re
quired by the Penna. statute, that it was enough
.• to say that-the statute itself settled that ques
tion:.. The - words were "Haar by affidavit of the
party, or somcother person or persons.' 'Rut even
• • if the language were not explicit, legal construc
tion would givelhe right. •
Hamilton, who stated his points of argil.:

- passed in too - hurried a manner. It seemed, in
one vieiv`of this case, to bo a hardship .that no
adequate remedy_ existed. If the • affidavit had
• : shown fraud in the inception of the contract,
and the Court could be satisfied on that point,
he would have no hesitancy in the matter. As
it was, he would order the dischrrge of relators
* upon common bail.

Disgraceful' Factory Rict.—We sincerely re
gret that we are called upon to record another
disgreeful Factory Riot in our city. It is ex
ceedingly }looking to see:human beings, partic
. ularly females, so depraved. We could not
have believed that such • an occurrence would
have taken place, since the result of the riot in
1849,.na's so disastrems. . But 'such is the fact;
a serious assault was made this nuntineupon
the Hope Factory near the Aqueduct • -
• . 'The circumstances, as far as we can learn, are
follows: This morning, . shortly after the
'Penn Mill had started, a steam pipe was bursted
when they were compelled to stop, and the oper

.to the proprietors of the Penn, proceeded to the
EaglePabtory and joined with the operatives there
' nearly all 'of Vrhom had turned out, at breakfast

The girls, we.believe, were the only actors in
. the scene, and they were led on by two or three
"Captains," one of whom we afterwards saw
pissing the Eagle Factory,-add making use of

This occurrence is much to bu'regretted, when
it is generally, known that the factories, which
render employment to hundreds who would oth
erwise be destitute, crinnbtle kept in, operation
'ten 'hours per day. And at best this is the
most_ erroneous method of accomplishing what
they Wish--nothing

and.we hope, ere Jong •the instigators of this riot
Will see the-error of their ways and -become

Ward, Allegheny. They are covered with a

sioner should attend to it at once.
Mistake.—Thomas Carney , was yesterday
brought before Mayor Guthrie, accused of hav
ing taken a pair of„ pantaloons, the property of
Patrick Belly. He proved conclusively, howev
er, that be had purchased them 'from a Mr. Mc-
Farren, and was honorably discharged.
Theatre.--The new Extravaganza made quite
a hit last evening, and will be repeated to-night
for the benefit of. Mr. Phillips, with other excel
lent entertainments. Remember this is positive
ly the last night of the season, and crowd the
house on the occasion.
- Con tractor lined.—The contractor for building
a house on Fifth street, was yesterday fined ten
dollars by Mayor Guthrie for having a Taint
open, to the danger of people passing by.
MainStred.—A number of workmen are busi
ly engaged in grading and paving Main street in
Allegheny. '
Unpleasant.—The water in the canal basin has
now an abominable smell. It should be let off,

when the Judge Advocate read an order. from Ad
jutant General Jones, by direction of the Presi
dent, commanding the Court to await further
orlerrs,- before the conclusion of the present
trial. Titudefence of the accused commences
at 1 o'clock. ,
The Court Martial metagain at 1 o'clock when
Mr. Carlisle, counsel for. Gen. Talcott; read an
able and somewhat lengthy' defence, after which
the Court adjourned for consultation.
Gen. Talcott will be probably acqnitted.
The court is retained for the trial of certain
New Mexican officers.

A distressing accident occurred at 11 o'clock
this morning at Brown's new hotel. A platform;
some fifty feet high, broko down, and six men
who were upon4t were precipitated to the foun
dation of the building. All of them were badly

which became so sore that I could - not use it, and in •

ders to the fore arm, my arm was full of running sores,

stopped the mortsficat.on, but could not heal my arm.—
