sel, and several other members of the bar made
paoH statements to the Courtus they believed the
'peculiarity of the case , required.
Mr. Fleming said he, was aware the law was
no respecter of persons—Outt it looked equally
on high and low—on cleric and laic; but, he
knew, also, that the sublimest eulogy of thelaw
Was its liberality and its leniency. Rarely did
.such a prisoner as his client come before a court
uf•jtistice, and if ever the law should be liberal
and lenient it Was en .this occasion. . For, here
was a man of education—for the • third of a
century the wearer of the priestly - vestment, s
man who had enjoyed mil:or: s at the honors of
learning and of piotyr,. but, who:.in evil hour
had Men. • _.. .
Ho was born near Dusseldorf; took the degree
.`of:Doetor of Philosophy in the UniiersitY of
' •Bonne ; 'was set apart to the priesthood .in
ogne; and installed Pariah Priest and Rector of
the Gymniisium in Cleves. On the accession of
• Pins IXth he went to• Rome. From Rome he
came to Lyons, in France, where he wan Profes
sor in a College. Ho was next sent - but by the
House of MislidorlEl to this country. Owing to
some disagreetnent between him and the Arch
bishop of St. Louis, he left Missobri and arrived
in Pittsburgh, where in a fit of aberation •of
•- - mind he committed the larceny of a watch.
Mr. Fleming appealed to the Court if it was
.. probable such a man would have noted in such a
• Way if hiihaa not been deprived of his reason.
Ile hoped that the prayer of the unfortumite
• stranger, begging the clemency of the Cork,
Would not be-unheeded, and read the following
letter of Lanrensen's, translated by him from
the Latin:— •
Honorable and Venerable fudges my pres
ent most miserable oondition---acionditiou which
Thave incurred by a violation•of the law—agits,
ted by the profoundest grief—l implore your
consideration. It was on my road to Philadel
phia that I did the act charged against me. • My
mind was disturbed-and perplexed. had I Lem
myself, I ttould not be a supplicant to-day. It is
the first act of the sort which can he imputed to
me. Never have I been before a Judge or before
_a Court. Aly testimonials, in every relation, are
the best, and, my counsel is empowered to pro
duce aem. 1 would, therefore,. beseech the
Court that they would oonsider propitiously and
clemently all the circumstances, and look upon
me a stranger in the midst of strangers, ignorant
of their language, friendless and.penniless, more
in pity than severity.

Lalitoya. Four years have elapsed since it was
fought and won, mid yet the twenty-first of June

'revive old associations—to bring together the
hearts of• those who stood shoulder to shoulder
in that hour of peril.:::
The Duquesne Greys; of this city, were par
tiCipators in that battle; and had apparently ef
fected ail the arrangements for a strong turnout,
a grand celebration on last Saturd.ay. The re
miniscences of the contest rose vividly in their
imaginations; the dark, wet night on•whieh it
was fought the thirty : six hours 'they rested on
their arms without food, and the suffering and
hardship they - endured on that occasion, , all re
curred to their memory, arid they were cheerful
ly to truckle on their armor to "fight the battle
o'er again;" but to the surprise and mortifica
tion of the few who never fail to bc on duty,
there was at the Ariaory, for an hour. or two
after the time appointed, but a mere luurlftil—
Lieut. - Trovillo, Ist Sergeant Chas. Glenn, and
some seven or eight privates—which, not being a
sufficient number to turn out, they aisbanded
and returned to their homes, grieved; at least,
that such should be the result.

the Diapatch, on a motion in arrest of judgment
to "show why Hart should not pay 'costs, Mr.
_Coctlraa said he was not prepared to argue it to- I
d 4, and asked postponement ; until Saturday
"last, which was.refused. Court then re
tucked, that-Hart being chairman of the meet
ing, he was acting in the-public capacity con
templated by the coristitation, and that his scar
. ified character and dog-eared reputation was a
proper subject for newspaper investigation. The
Court. was not mistaken in the law, nor the Jury
in the facts, and he would not disturb the ver
dict. '
First Presbyterkn Clturch.—We are pleased to
learn that the members and pew-holders of the
First. Presbyterian Church, in this City, have it
in contemplation to erect a large and beautiful
..:new-edifice, on the present site, on Wood street.
There is not a more delightful location for a
church in the City than the above, and front our
-knowledge of the wealth and enterprise of the
members of the First Church, we have reason to
believe that they will erect a building that will
be an honor to themselves and a credit to the .

tempted to break jail on Friday last. He had
procured a bottle of vitriol, and with that had
eaten off one of the: legs of his iron bedstead,
which he was Making good use of when discov
ered by Jailor Fox.' He was so enraged at the
intrusion of the-Jailor, and became so violent,
that he was put in irons: Whoever escapes from
Fox will have to rise earlier and lie down later
than he does.

several indictments of larceny with Wm. Jack
son, but against• whom there was not the first
particle of evidence, while the latter was con
victed, was brought into court on Saturday and

The steamer Cherokee arrived this morning
from Havana, bringing California mails.
• . The Cherokee left Havana on the 16th inst.—
The steamer Falcon arrived at Havana on the
16th, from Chagres, with 500 passengers. There
were no American vessels at Havana when she
Sailed. Havana is perfectly quiet, and the sud
den departure of the Intendent for the U. S. has
caused some excitement and much regret.
The Cherokee brings 300 passengers.
It is officially announced to-day that the cor
ner stone of the enlargenzent of the Cipitol will
be laid on the 4th of July by the President.—
Hon. D. Webster will deliver the address on the
occasion. The citizens generally are invited to
participate in the ceremonies.
The President, accompanied by Sec'y Stewart,
left this 'morning in the steamer Osceola on a
short visit to the Fortress Munroe and to the
Gosport Navy Yard.
William C. Brown was brought before Judge
Crawford, in the Criminal Court to-day, attended
by Mr. Buel, of . Michigan, as counsel, and gave
bail in the's= of $l6OO for his appearance at
the December term. B. B. French is his secur
ity.
A large number of old muskets and tents were
purchased at the Goren:anent sale to-day by two
New York gentlemen, who declined giving their
names.
The Grand Jury have found a true bill against
Day, for the wilful murder of his wife. The tri
al takes place in about a fortnight.
The City Councils appointed a conimittee . tti
wait on the President at Old Point Comfort, and
invite him to visit Norfolk.
The authorities of Portsmouth extended a
similar invitation to him.

California letters are less discouraging than
paper accounts. In New York there hare been
several small failures, in the the California trade,
since the receipt of the great disaster; i the
opinion, however, is becoming general 'that the
loss is greatly exagerated and does not in reality
exceed four millions. Two or three failures aro
also reported in Philadelphia; but there will be
no panio.
The Mississippi is rising again at St. Loul9;
and in the Missouri and Upper Mississippi,
another flood is expected.

drowned yesterday morning.
Two canal boats, bound from Chicago to St.
Louis, was sunk by the steamer Briggs I; the
Illinois river. • . •
The river is 5 feet 7 inches and the weather
hot. The steamers Empire State; Europa and
Memphis passed up. The Fashion arrived from
St. Louis in 43 hours. She ran one hour and a
half on, one wheel, and had• three hours fog.
