Black asked for,a; continuance of the case, as against his client, Jackson Cornston, until the nest term of the Court, alleging, as a reason, that ' ’the prisoner had been unoblo, until this morning, 1 to procure counsel, and consequently was not ready , ■ for trial. , : ; Mr.Swcilxer, U. S.Deputy Ally. General, op ' posed Ihs mbtion, because the proper legal grounds were not laid; He said, a few days since, In the case of the U. S. against Wheeler, from Somerset ' county, the prisoner had been, taken to a distance from his home, and had been unable to fee counsel S nd procure the atteudanco of the necessary wit nesses; hot this was a different caso altogether, ■ ■ for the prisoner’s friends and witnesses were in this city. ■ Col. Black said that he had only boon employed this morning, nnd as yet had no opportunity of con. suiting with hiscliont. ■ Judgo Irwin ordered the necessary affidavit for a continuance- to be drawn up; which Was done by - Col. Black, who then observed to the Court, that ir ’ it did not comport with tho atricl rule of law, there was at least an equitable reason for its admission, , - and he presumed that under tho circumstances the . Conrt would grant it. The Deputy Ally. General apposed its admission;, hot Judgo Irwin said ho must presume tho affidavit ■ lo be tree, and would conlinno tbo case until the first ’Monday in-May, and directed the prisoner to ■ enter into the necessary recognizances. Mr. Bnrko thondrow op an affidavit for his client, Thos. H. Scott, and this case was also continued. The United Stales declining to try the caso of Robt. Corriston, alone, it was also continued to the same time. The Grand Jury returned with several now in dictments ogainst thopnsonors, and ignored the bill ogainvt John Corrißton. No ether business being before the Court, the Traverse Jury were discharged, aad the Court ad journed till to-morrow at 10 o’clock.
