A question of infringement is one of fact, of which the
ury are the judges The construction of the patent is
for the Court.
After reading and commenting on the specification of
Plaintiff's patent, the Court observed: In doubtful eases
it is not tins custom of the Court to express any opinion
of the lams of the ease ; hut in thin case the facts are un
disputed, and the Court think it is proper to state, as the
opinion of both the Judges on the true construction of
Plaintiff's Patent, that the Defendant's Patent is a gross
and palpable piracy of the Platnuff's invention.
It has evidently been obtained on the ground that it
was an improvement on Plaintiff's patented invention,
and now seeks to usurp his rights under pretence of an
improvement—a pretence which is proved also to be un

The above decision gives to the subscribers alone the
right to ruanulacture Chilled Rollers, by the only process
known to produce a good article.
