After reading and commenting on the specification of Plaintiff's patent, the Court observed: In doubtful eases it is not the custom of the Court to express any opinion of the tants of the case ; but in this case the facts are un disputed, and the Court think it is proper to state, as the opinion of both the Judges on the true construction of Plaintiff's Patent, that the Defendant's Patent is a gross and palpable piracy of the Plaintiff's invention.
