CHARGE OF COURT.
A question Or infringement is one of lam, of which the
ury are the judges. The construction of ibe patent is
for the Court.
After reading and commenting on the specification of
Plaintiff's patent, the Court observed : In doubtful cases
it is not the custom of the Court to express nity opinion
or the Inas of the case ; but in this case the facts are un
disputed, and the Court think it is proper to state, as the
opinion of both the Judges on the true construction of
Plaintiff's Patent, that the Defendant's Potent is it gross
and palpable piracy of the Plaintiff's invention.
It has evidently been obtained on the ground that it
was an Improvement on Plaintiff's patented invention,
and now Oaks to usurp his rights under pretence of an
improvement—a pretence which is proved also to be un
founded. Per Curiam R. C. GRIER.
The above decision gives to the subscribers alone the
tight to manufacture Chilled Rollers, by the only process
known to produce a gootartiele.
