Circuit Court at Philadeldhia, Judge Grier presiding;
evidence was produced by the Defendant,rfCounsel
to prove among other points of defence, hat- the

testimony of 'Captale'Dennett, of Wheeling was in
ken on thin point, and his credibility and competen
cy ae a witness, were alfinned, and thrtified by ottani
seta; on the ground of his great. experience,. and'itt
virtue of his having been for several years past,
pertmenting in steam boat building on the Ohio rev
er.•
Two memorable instances, the last two &rate
built by him, were cited of the practical value iifhla
skill and experience, to the construction of_ boats,
and the adaptation of machinery to their propulsion.
Captain Bennett badtbuilt the steamers A. John
son and Embassy, whose names are indentified with
the most appalling disasters and destruction of hu
man life that have hipponed to upper - Ohio' Ideate
boats. •
These acridents Were attributed .to defective ma
chinery l They were In both cnaes explosions, at.
tended by great loteOf life 1 • - •
This Captain Beopett, be it observed, bailtTed
`stiperinteaded the beading, of both those tempera
ble steamers.
Now we would ask, what is the : value of the testi
mony of
,a Mao, caste the proportions or :capacityof
steamboat machinery, whose "experiments" in that
line show him to be utterly disqualified, of • o 'vast
expense of human life, to pronounce an opinion . on
the subject 1 Oar reference to this bloody expert
, anon was needful to our topic, and we made it 4n

" Wheeling produces a areatoboarcaptain to peeve
that be thinks our boats hate too high chimneys, who
has in the course of his experimenting to prove the
factolaughtered on the A. N. Johnsion and Embassy
steamers, ecoreacif, men, women and.children. A
valuable witness was this Capt. Bennett, and if his
testimony be good as to the capacity and adaptation
of steamboat machinery to its ende,he ought new
to be rotting in a Penitentiary.".
Now, what do we affirm here t Simply that if
Capt. Bennett be competent to judge and lay down
rules for steamboat machinery; be must be compe
tent to judge the insufficleocy of a steamboat's butl
ers and of the premiere to which theymay hosubjeb
ted in working. • And if hi wan thus competent, he '.
could not fall to pe'rceive that explotion must over
take the A. N. Johnston and Embassy. Then why'
were the explosiona permitted to occur t "
We have inferred, tt was either owing to his defi
ciently of knowledge, or culpable negligence and in- '
diffprenco to the safety of his.passengers and crew.
The Act of Congress, then, would subject Captain
Bennett to imprisonment in the Penitentiary, al door,
declaration wastrierelythht he , ;were of compel
tent'skill Mad knowledge' the expliinitnie resulted'
from negligence, aid the Act of. Congress contetn;
plated his steptisonment to the Penitentiary. •
To escape that. dilemma, Capt. 11 , 0 friend must
concede to hint Iliat he was not, as his airing evi
dence informed ache presumed, and professed, to
be, of competent skill to pass an opinion op steam
boat machinery, whether boilers . tor chinanayti , or
floes. Seizing thts alternative, our laeguage was in
effect, that hie evidence was utterly worthlessvand
our words were valuable witness was this Capt.
Bennett." o
Now we repeat that, if he was qualified to regu
late the machinery, of our steamers, ho mnst have
known enough about the defects of iiiotonexpleded
boats, to bate been guilty of negligence to permit
ting their explosions—and no he becomes. liable to
the penalties of the Act of Congress. We , presented
both horns of the !dilemnie; but, although In sharp
phrase, we indicated to Capt Bennett and his em
ployers the propriety of his accepting that ono which
would relieve him , lrom the imputation of criminal
negligence, or indifference, at the expense. of his
pretensions to skill in machinery ; and 'would dis
credit his evidence, as, in pursuing our orpiment,
was oursim and inclination, if not our defy.
As to the allegation of Capt. Bennett's friend

We have been long enough connected with thii
public.preas to observe narrowly, if not from correct
taste or generous principles, at least from deference
to public opinion pad obedience to law that distinc
tion which the lacy of libel makes between the at.
teraace by the public preen of harsh truths for the
promotion of the public welfare, for the prevention
or abatement of a public nuisance, and that,liceit
tiousness of news opera which permits editors, to
vituperate or assail private persona or public officers,
from motives of malice or personal revenge. It is

And what haveinre said in disparagement or doubt
of Capt. Bennett's private character and . cciadtiet
Not a word. We do not know hint at all and - he
may be all that'hia advurtisenunit 'tepresdnts him, a
man of ".integrity of character," of " humanith
liberality and courage.". And, indeed, knowing
nothing whatever to the contrary, weshould be both
very wanton, aad!falthlese to the duties of our re
sponsible vocation, did.we not volunteer to accord to
him the possession of all these qualities. la waking
that concession, however, it is proper that we shall
remind these " fire eaters" who charge uit - with
cowardice,» while they claim "courage" for Capt.
Bennett, that we make it in accordance, with' the
prOmptings of out own self respect, under enem,
of what justice to, the private, character of thendi
vidual might extort from our truth, did we known
him personally: It is a concession made riot to
deprecate their wrath to disarm their temper, or
invoke their forbdimice In any forth, but to , leave
them withoutfust, cause of complaint that, in pursu
ing a topic of public concernment,. we have seized
the occasion to depart frowitspubtic aspecitcrasiall
private character.:

yield it to them freely, and boartily ; reserving the
little privilege or repeating, on all suitable .occa-
