Airraifoor? session.
The court was densely crowded ell the afternoon,
TJiecase of tboFactory Riots were again taken op. - '
Mr. Darragh nrgoed from the books that the in
dictment should bo quashed, on account of error on
Jts face. He contended that a defect aa to one of
the parties, effected the whole bill.
Mr, Shaler said .the Coart must quash altogether,
if the omission of the word," yeoman »> rendered
the bill imperfect as to some of the parties.
The Coart doubted its power to qnasb the whole I
bill: suggested that the object or the defence might
boar readily attained, 5y entering a pleaio abate.
mCDI. .v-r-i-e:: I
Mr. Darragh preferred (hat tbe motion to quatb
should prevail, aud went da loroad amhOntioa.
Mr.Ulaci insisted upon the motion to quash, and
read rrom liord Bacon the law in.such a case.'
And so tho discussion moved along with aiuma
tinn, fuo, lury, eloqaence and wit on all sides.
At length, thequejtiotnvossettledbj’ theCloun,
Oius: •< Wo direct tbe indictment to be quashed as
,to the males.”
Mr. Sbaler desired to know ir the parties would
bo required to enter into rcqpgnlzancos to appear at
I tho next term. J I
Mr. Black cipreaaed a wlllmgneu to argue U.e
point.
The Court remarked, that it was a general thing,
to require parties to enter into recognizances to ap
pear at the next term, after such a process. They
are still under the old recognizances, and have not
been discharged. We will give them a few day* to
renew* » *, 4
• v, Mr-Shaler then ashed foha. continuance ai to tho
naraeawcrff still on ibo jodictmenr.
£ T * ,e Court intimated that the case should be con
tinued. 1
Mr. Black begged be might bo* heard before the
fateof tho girls should be sealed. , * '■
Mr. SlaDton lauged outright. J ' -
■ %! Block, said be was glad to hear the gentlitman
laugh; and then went on toshowtdiybewaa gladJ
We did notexac.ly catch hisreaeoning on this point,
however. But he made a beautiful address to the
Conn in favor of an immediate trial.
The Commonwealthgave notice that they'would
be ready to-day j the defendants had come prepared,
and demanded n trial ns a right. They were all
girls; poor and dependent upon labor for support •
had been ostracised, and chuld ’get no employment
while an indictment .was hanging osertbemV :, ? -
We understood the Court to say, thatthe Common:
,Wealth had no right to a continuance, if the defehi;
dsnts had come prepared and insisted upon a trial,'
r without giving a good reason. l • • '
Mr. Shaler contended that the whole bill had been
quashed,by the-procoss'of the Court, add that said
process—quashing as to the males—had placed them
in a different attitude.. They were not ready under
tho new aspect of the ease. _ ■ ■
After some further discuutoo, tho eoptasel for
Commonwealth asked that the mitre hdl ’of indiet
meat might be quashed. r
r . |he matter ended for the present- "h-
