charge, and the same may be sa id of the
charge Oa violation of the appropriation
act ofliarch' 2, 1867;' and these are all
the !Ars alleged to have been violated. It
is to - tvever, charged that Andrew John
son has violated the Constitution. The
fact may be so, but where is the evidence
'of it to be found on this record ?
Others may, but I cannot iipd it. To con
viet and depose the chief magistrate of a
great nation, when his guilt was not made
palpable by the record,and for insufficient
cause, would be fraught with far greater
:danger fo:the future of the couutry, than
can arise from leaving Mr. Johnson in of-

ons why he could not vote for the impeach
ment of the President, we condense the
following:
He began"" with g -eOnsideration of the
President's power of removal of the heads
of depatttnents under the Cons:itution,
quoting many authorities to show that it
was not denied or abridged up to the pas
sage of the ; epnre of .office,aet. .Ppasing

ion of whether Mr. Stanton's case comes
within its provisions. Ile did not consid
er the Secretary of War either within the
first section of the art, of the proviso, and
quoted the ileclaratichis of Mr'. Schenck
and Mr. Sherman on the passage of the
bill in March, 1307, to sustain the theory.
He thought Mr. Stanton held office under
the pleasure of the President alone under
theact of 1789, and that the President
elotie could remove him. He did not think
there- was any distinction between the
power of the President to remove during
recess, and his p0'.4.-er to remove during
the see on of the Senate, an officer who
held solely by his pleasure.

dismissed the conspiracy articles very
briefly, adlie :did also the eighth and ninth
articles.
He then took up the qnestion of intents
saying he had no doubt that the Presi
dent thoroughly believed the tenure of of
fice set we's unconstitutional, and said that
he was advised of its unconstitutionality
by Mr. Stanton and other members of the
Cabinet, and Mr. Grimes thought it not
Strange that under the circumstances the
President should doubt or question its
scope. He held, however, that Stanton's
case was not included in the provisions of
this set, and that, therefore, the question
of intent need not be considered, as the
President' had done no unlawful act. But
even if it were included, the guilty intent
was not such as warranted the judgment
demanded by the House. The Senator
wept „on, tosay that if the President
might not 'this' way make a 'case tbr-the
