Jumes O'Neil, who has served more than eight years in the State Prison for a crime which it in proven that lie was entirely innocent ot, , was liberated on , Friday . afternoon, shortly after the Senate consented to the pardon, if pardon it can bo called. The news was broken to O'Neil gently by his counsel, W. B. Whitman, Esq., of this city, who had thought best not to inform him that efforts were being made for bin release, that ho might not be disappointed, nnd they were-at ilrnt too good news for him to believe. The poor fellow passed the outer door of the prison, for the first time since his seutence, like one in a dream and as he reached the street drew a long, deep breath, with the heart felt remark, " How sweet the air smells." After ho began to realize that ho was really released, he said he suffered more when told he was free than when ho heard the scn tenco of imprisonment of life passed against him. Ho was taken in charge by a brother-in-law who lives in Philadelphia, and left with him on Saturday for his home ii) that city. His parting wordB to his counsel, ns ho was about leaving the earn, were: "God bless you, sir; only for you, Id be in the prison now, 111 pray for you; and if you ever need a man to die for you, send for'mc;" in a manner that left no doubt of their sincerity, and which must give his counsel a satisfaction that cannot be esti mated by money, and compensate him largely for tho time spent in his behalf. During tho time that O'Neil has been in prison he has acquitted himself well, nevor having been punished a tingle day. The confinement has worn on him somewhat, and his mind is now in rather a weak state, so that ho will have lobe cared for until freedom strengthens him, which it is hoped it will do. His brother-in-law who comes well recommended, will havo the care of him, and is trustee of whatever sum tho Assembly my see fit to appropriate for his use. O'NeiTs friends and family arc poor, and it would be a simple net of justice for tho Stato to pay him for the time ho has been compelled lo serve it, at least, the usual amount allowed to a convict working out a fine, and costs, namely 83J cents per day. Can anything less than this hot jus tice '.' Mr. Whitman deserves credit for his zeal and success in working up this case. He first satisfied himself of O'Xeil's iuno oor.ee, and then went to work to procure reliable testimony fliat would convince everybody; uo small matter, whou it is con sidered that the affray hapiKmcd nearly Ion years ago, and that the "witnesses were scat tered all over the country, and many of theui had since died. Tho rumbling insido tho volcano continues, but no fresh craters havo opened, and the lava has censed flow ing. , In the afternoon showers of snnd succeeded the rain of ashes, which was fall ing in the morning.
