know William Meeser, and if I were to see him

anything else. I consider lam as lomnly
bound to tell the truth by affirmation as by
swearing. If the Court compels me to swear I
will do so.
Judge Brewster—You must take the book un
less you have conscientious scruples.
The witness—l have too much respect for the
book to pick it up tin avert' trifling occasion.
Judge - Brewster, Wonla it violate your con

Judger Brewster—No man, perhaps, likes to
do it., but it is a necessity that must be complied

The witness—lt would be a violation of my
conscience; I will tell the truth by affirmation the
same, as by oath. • •
This was considered satisfactory by the court; ,
and the witness proceeded.
Attorney-General Brewster seated the offer.
Mr. Brown said he proposed to, prove that the
witness was a soldier; that he entered the service
of the United States when it needed , soldierii for -
the purpose of protecting the Union.
Objection made.
Mr., Brown said he objected, to - Kr. Mann's
statement.
Attorney-General Brewster—Yes, he was on
' the stand throughout the time, and luckily you
were not.
Jude Brewster thought the entire offer , could
be made.
Mr. Brown - resumed—That at the time the wit'
nem entered the service his object would be
• shown; in what capacity he entered; When pro
moted; when and how ho loet his leg; when he
was discharged; whether honorably or otherwise;
- what he had done since for a livelihood; that he
supported himself by writing for newspapers,
having no other means of support; that he wrote
the article in question in Fayette county,
Pa.,

mere romance and fiction, and that the other tWo

Attorney-General Brewster could not see what
any of this offer had to do with the case. Mr.
Mower was indicted for"publishing a libel, and
it makes no difference who wrote it. He was
indicted for the effect produced by the publica
tion of the article.
Judge Brewster said the publisher of a -news
paper or other publication was liable either
civilly; or criminally for the publicatian of a libel,
although be might be hundreds of miles away.
A newspaper was conducted for profit, and the
publiSher must see that it is an engine for public
good and not for private oppression. `The pub
lisher was just, as liable as though he had left
powder nwier a house and retired to a distance ,
of tulles away and set it off by a slow-match.
The question was did, the evidence show that an
article was published maliciously,

Two witnesses• were called to show that the
ofilee of Mr. Mann, at Fifth and Gfettn streets,
was a city building; and the defence closed.
The commonwealth offered as rebuttal a copy
of the Sunday Mercury, dated November 24, in
which editorial attention was called to the article
charged to be libellous, which was admitted, and
the case closed.
Counsel then summed up their arguments, and
the Court adjourned. ,

Frightful Ilittirolul_bhuseter In Ver.
snout.
MONTrEuza, Vt.,- Dec. 11.—One of the most
fearful accidents known in the annals of Ver
mont occurred to•day at Barlow Bridge, near
Northfield, on the line of the Vermont Central
Railroad. The bridge w,as burned on Sunday
morning, and during the week about one hun
dred men have been engaged hi rearing a trestle
work for temporary use. Most of the employes
having dined to-day at Northfield wore return
ing to work, about one and a half miles from the
town in a passenger car, which was being hacked
up to the works. ,
By some inconceivable forgetfulness, the en
gineer proceeded with them at a rapid rate ;and
did not check his speed until -=too too , kt.e, and 'the
whole car. with its freight of seventy to one hun
dred men, was backed off •the abutment into the
river below, a distance of sixty feet. The num
ber of casualties is appalling. Fifteen men were
'
instantly killed and three or 'four have since
died, and some, twenty others are more or less
utrmy serio y; and some ' fatally. The
casualties consist o broken arms and legmlisloca
tons, cuts, bores and bruises. • Among the killed
we, Atmore Weatherly, of Northfield,- Timothy
Moht,of Alburg,and Chas. R. Clark,of Bt. Albans.
E.C. Chase, of Manchester, is also injured.
/MOTHER ACCOUNT.
tURLINOTON, Vt.. Dec. 11.—Abont seventy
workmen, mostly educated mechanics, dined at
the Northfield Hotel, at 12.30 to-day, and imme
dintely afterwards proceeded by a train coin
polted of an engine and owlpassenger ' ear ' to
Rarlow Bridge, • about one and a half miles dis
tant, up a heavy grade. The train moving back
ward as they approached the bridge, the engineer
could not shut off steam readily, and only suc
ceeded in checking speed in time to save the en-,
gine from golpg over the abutment. •
As the centre of the car struck the brink of the
precipice it broke into three pieces—the roof
sliding forward, and half the body falling seventy
feet to the river bed. About twenty-live men
were spilled out in a pile on a shelving rock
twenty-live feet below the track, the rear half
of the car falling upon them and the tender upon'
that. .It was here that most sr the deaths-- oc
curred.
About ten persons sated themselves by jump
ing from the car. Scarcely any escaped serious
injury. Superintendent W. H. Locklin. who
was on the, rear platform of the car, and Mr. W.
Tenny, master bridge-bplider. who was on the
tender, escaped by,:jumping. Tke dead and
wounded were brought to Northfield by cars and
sleighs, and surgeons - Were called there from all
thaeastern parts of the State.
_A special train from this city carried up physi
cians and help. Those falling lth the half of
the car that first went over the ntire seventy
feet'are mostly all living.
There are many rumors afloalt. , ensuring the
engineer, but many believe thur w4en ho
whistled to atop the tratp,the engine was`beyond
his control. His name is Frank Abbott, and he
has been in the employ of the company many
years. The inquest twill be held immediately.
