ACTIVE OPERATIONS COMMENCED
IN BALTIMOIIE
THE REGULAR POLICE EJECT THE
SHERIFF'S POSSE.

134 "g/MORE, Nov. 3.-,-At 1.30 P. M. a few
Of the regular policeforce appeared in theves
inn le of the Court House and commenced at
once to eject the Sherlirs posse, who were
Crowding up the Stairway from the south en
trance to the Sheriff's office above. A
Seep :Ice ensued, and for a time there was
eensiderable confusion, and; much threaten
ing lan_griage was used. Many of the spec
taters,becoming alarmed,made whasty exit
from • the httildbie, causing much exeite-
Ment outside. Presently, the new Commis
sioners were seen approaching the north
entrance of the building, on Lexington
street. They had scarcely entered
when • Marshal Carmichael appeared
coming from the direction of the Central
Police station, at :the head of a large, body
of police, wdo made a rapid entrance, and
in a fewmoments cleared the Sheriff's posse
out of the building. On entering the crimi
.
.nal court, a 'deputy sheriff appeared and
announced that the bench warrant:for the
arrest of Valliant and - Young had been
served, and in a few minutes thereafter the
Sheriff appeared with Measrs. Valliant and
Young in :.custody.' The Court informTd
them that there would be an opportunity
'afforded them to procure counsel. Presently
their counsel appeared, and inquired for the
affidavits upon which the arrest had been
made.
The Statei Attorney briefly recited the
evidence that had been given by the wit
nesses upon whose testimony the bench
warrants for the arrest had been issued.
The counsel for the new Commiisioners
then proceeded to argue that the arrest was
an unwarrantable one. Their clients were
the duly commissioned Commissioners of
Police, and were exercising only their legal
authority.
Judge Bond had already replied as
follows to an application for a bench
warrant:
"As the State's Attorney for Baltimore
city, it is your duty to bring to the notice
of (lie Court the very grave facts you have
just mentioned. It is the only tribunal
here, charged with the punishment of
crime and:the preservation'of the peace,and
whatever power it has for these purposes,
should be immediately invoked and exer
cised to prevent the violence which you
suggest is contemplated. •
"It is not our duty to determine the ques
tions in.dispute between these claimants of
the office of Police Commissioners, but it
ought not to be truthfully said that in a
Government so long established as that of
Maryland the only way to obtain posses
. Edon of an office is by force of arms. The
Courts are open. An appeal to them can
be speedily heard, and all official rights
determined.
"This course must be pursued and any
array of force for any purpose of this kind
is an unlawful assemblage, and the parties
engaged in it are guilty of a breach of the
peace, and must be immediately arrested.
All the power of this court shall be exer
,
cised with vigor and promptnesS to prevent
such a violation of law and the - public peace
shall be preserved at all hazards.
"The factthatpersons clairnitigrightfally
or wrongfttlly to be Police Commissioners,
are about to place persons on the streets, as
pollee officers charged with the duty of pre
serving 'the public peace, is calculated to
alarm.the public mind.. The dread of colliseion -
betwem the two forces, and of ulti
mate armed conflict, will fill the minds of
peaceable and order-loving citizens with
terror. It is impossible that this should
be allowed'if the law can prevent it, and
the warrant you ask for Sindl. issue.

Sheriff Thompson was also required to
give hail hi the same amount. It is under
stood that all the parties refused to give
bail, and is..expected they will be corn=
witted. There are reports that they intend
to appeal to General Canby to be released
from custody.
\ The new police officers have clissapeared
from the streets. Some of them have been
arrested. All is quiet, but a deep interest
is manifested in, the large croxVds of people
on the streets eagerly ditionssing affairs. ,
The old board of police , have ordered the
closing of all taverns and , places where
liquor is sold.

The parties have been committed to jail
havindrefused to give the required bail. I
is now rumored that inertial law will be de
dared by Gen. Canby.

that troops were , to-day sent to that city,
to be ready in ease of emargency, and that
if there shall be any extensive _hostile de
monstritions on the part of the citizens, the
United States anthorities_will interfere, and
declare the city under martial law. ,

cholera reported at the office of the Board
of Health was 24.- •
The records of the Registrars' office silo
that during the same period there were 41
;deaths from cholera in the city. Of that
number 38 were adults: .and-3 children. 25
were males and 16 feinales. - Sevirat of the
deaths reported were from cases of last
week, which accounts for discrepancy be
tween the number of cases reported and the
deaths. ; • :

murder of Mary Cat ney,' , on the tenth day of August
last, was resumed this morning. Yesterday the de
fence concluded its Ustlmony in support of the pri
soner's insanity. In 'rebuttal • the Commonwealth
called the physician and keeper at the prisno, both of
whcm described-the prisoner's manner , and behavior,
and gaveit as their opinidn that he was sane. TO-day
tha case will be argued to the Jury.
