VIENNA, Nov. 4.—Decrees have been pro
mulgated relieving Mensdorif from the
Foreign Military office, and appointing Von
Benet - as his successor. The decraes also
appoint Baron John Minister of War, vice
Es terhazy,relieved. The Ministry is without
portfolio. Van Banat has issued a circular,
wherein he declares himself separated from
the post. He-says he enters the Austrian
service free and unprejudiced. Austria will
maintain a true and peaceful conciliatory
policy, but. will uphold the dignity of the
empire.
Fbonvacc - E, Nov: 4.—A deputation from
Venetia had arrived at Tarin, amid great
enthusiasm. The Bing and Cabinet were
also there to receive them.
BERLIN, Nov. 4.—The King of Saxony
and his family re-entered Dresden yester
day, and were well received by the people.
The German Parliatitebt, it is expected,will
be ready to meet at the beginning of the
year.
BRUSSELS, Nov. 4.—Chosen, the Belgian
War Minister, has resigned.

NEW Yoxx, Nov. 4.—The steamer City of
Paris arrived to-day, with Liverpool advices
of October 2d, via Queenstown October, 25.
The steamers 'Louisiana and Atlanta have
also arrived from Liverpool. The steamer
England sailed from Liverpool October 24.
The weekly sailing of -the Cunard extra
steamers has been suspended, but they will
leave revery ' alternate Saturday for New
"York, commencing: October 27.
The Mechanics' Magazine says the British
' government has ordered a 15-inch Rodman
gun, with improved carriage, shot and pow
der from the United States. The gun' will
probably arrive in five or six weeks, when
we hope for a settlement of the question be
tween liritish and American Ordnance.
The Prince of Wales would leave England
for Russia on November 5, with a numerous
suite, to.attend the marriage of the Princess
Dagmar with the Czarowiteh.
The "Standard" Theatre, at the east end
of London; was burned October 21. '
The War Secretary had invited proposals
for breech-loaders, to replace the present
rifles need by the British army.
Mcßae, the -Liverpool agent of the con
federates, who was sued in court at Liver
pool, by the United States Government, Ito
obtain information as to what property was
in his possession belonging to the late rebel
government, had been allowed a fortnight's
time.

Advices from Cape Town state that the
Bassutos are starving, and a renewal of the
war is feared.

The V. S. District Court of Virginia.
FORT MONROE, Nov. 2.—The United States
District Court having adjourned yesterday
to meet on the first Tutt,sday in December,
Judge ,Underwood, last evening, took his
departure from Norfolk for the North. The
charge delivered by the Judge to the Grand
Jury, although somewhat ambiguous in its
language, seemed to distinctly foreshadow
that Jeff. Davie will not be tried at Rich
mond, to which place the court adjourned,
to re-assemble at the time appointed. There
was also something remarkable in the omis
sion of the second - clause of the oath ad
ministered to each of the Grand Jurors
sworn yesterday. The following was the
oath administered to the foreman andjurors
by the clerk of the court, .Mr. J. E. Bod ges
—"Yoa will diligently inquire and true
presentment make of all matters as may Os
given you in charge or come to yronr know
ledge, touching the present service. You
shatl present no person through nor
leave any unpresented through fear or fa
vor, but in'all your presentments you shall
present the truth, the whole truth, and no
thing but the truth, so help you God!" And
the following was the portion omitted by
order of the Judge: "You do solemrllyswear
that yon will support the Constitution of the
United,States 'Of America; that you liftve
not, without duress or restraint, taken up
arms or joined : any insurrection or rebel
lion, giving it ' aid and comfort; that you
have not directly -or indirectly, given any
assistance in money or any other thing; to

Commissioners have made. application io
Judge Bartol, of the Court,of Appeals, for a
writ of habeas corpus, to •bring before him
th4arties now held in custody by the
waiden of the city jail, under the order of
Judge. Bend, of the Criminal Court. Up to
he i presont writing, the writ has -not been
erved on the warden of the jail; and as
1138paday, it cannot be served ; until
to-morrow morning. As it is a subject
much discussion when the writ will by
returnable, it may be well here to quote
the; aws o Maryland on the subject of
habeas corpus. , •
Section .4 of article 43 says that the officer
haying the party suing out the writ shall,
within three days after such service, make
return of the writ and cause the person
detained to be broughttbefore the court or
judge, according to the command of the
writ.
If this discretionary power of the Warden
to return the writ within three days should
be availed of, it is supposed the parties
may not get a hearing before Tuesday or
Wednesday• morning. It is not known
what course the Warden of the jail will
take. If the parties should be brought
before Judge Bartol to-morrow, it is pre
sumed the whole question and tfienumerons
points of law involved will be discussed
by the counsel on either side.
In order to correct some inaccuracies in
the brief telegrams of Saturday, giving an
account of the proceedings of the Criminal
Court, it may be as well here to give a copy
of the warrants issued by order of Judge
Bond:

of Baltimore, greeting: We command that
you take the bodies of William Thomas
Valliant and James Young, and them im
mediately have before the Court here to
to answer the charge of having unlawfully
conspired together, and with unknown per
sons by force and arms, and with a strong
band, to expel, remove and put out Samuel
Elindes and Nicholas L. Wood, Police Com
missioners of the city of Baltimore, from the
office belonging to and the property now
occupied and possessed by them as such
Poliee Commissioners.

The city continues remarkably quiet, and
with the exception of small gatherings of
people quietly discussing the situation, and
the numerous, rumors in circulation, there is
nothing noticeable out ofthe ordinary course
of events.

Governor Swann went to. Washington to
day.

SAN FRANCISCO, Nov. 3.—Gen. HaHeck
has received intelligence that the remainder
of the money stolen from the Paymaster
General of Idaho had been recovered, and
two of the soldiers of the 4th infantry, who
committed the robbery, had bzen captdred.
The steamer Active sailed to• day for Vic
toria; Vancouver's Island,carrylng out - $4OO,
000 in treasure.
Choice wheat closed to-day at $2 per 100
pounds.

Jeff: Davis's Guards Removed.
FORTRESS Att ONROE, Nov.-3,—The parole
granted to Jefferson Davis some months
ego, giving him the privilege of the ground
of the Fortress during the day, has been ex
tended, through Execntiveclemeney, in re
moving all surveillance over him and the
guards from his rooms in Carroll Hall at
night;
Instructions to this effect have been sent
from Washington to General Burton, com
mandant of .the Fort. This deprives hi
imprisonment of anythitg like severity,
and paves the way, as is generally pre
sumed, for his final parole and release.
All the guards over him both during day
and night, being removed,' lie now.. enjoys
perfectly tuatramme!ed liberty and every
possible.. means of comfort and pleasure
while' held as a prisoner in the Fort. It is
said teat he t has expressed great gratification
at this action of the government,:and already
contemplates vacating Carroll Hall and
taking up his residence , with_Mrs, Davis in
the casemates assigned her shortly after her
arrival here. .
