Bruce, the British; Minister here, upon the aubjOotof the conviction and sentence of James Lynoh and John MoMahon, by a Colonial Court of- Canada, on the charge of complicity and participation in the late attack on Fort Erie. In aooordanoe with the purpose expressed in that communication, you are expected to procure, without delay, for the use of this Department, a copy of the record of the trial and conviction of Lynch and McMahan, and also of all further trials and conviotions of a similar character, which shall take place in Canada, with the least possible delay after their termination. . , : I am, sir, your obedient servant, • Wm. 11. Lynch and John MoMahon have been recently convicted in a Colonial Court of Canada, and sentenced tor death, upon ,a charge that, being citizens of the United States, they were actors in the assault made in the month of June last, at fort' Erie, in thatcolony. ' • It can hardly be necessary to direct your attention to the fact that the Government of the United States is required bv thejtighest considerations. of National dignity, duty and honor to inquire into the legality, jus tice and regularity of the Judicial proceed ings which have thus taken place, and that, after making such a careful scrutiny, Wi shall expect to thake knownto Her Ma jesty’s., Goyemment’ suoh opinions a 3 the President, upon due' obinsideratioh, shall adopt. With this view the United States Consul at Toronto is this day instructed ,t> procure, for the information of this Depart ment, a oopy of the record of the trial and conviction of- Lynch-and. MoMahon, and also of all further trials and conviotions of a similar character which shall take place in Canada; While no unnecessary delay in the ex amination of the cases which are thus ex pected to come before this Government is intended,' it niayyi 'nevertheless,' happen hereafter, that delays will unavoidably re sult ;from past incidents or from future -events, whioh cannot now be foreseen, I have now the honor to request you to take such'proceedings as you may .think proper, to tne end that such applications of the Consul shall be promptly granted. ' The President directs me to assure you of; his confident hope that Her Majesty’s Gov-; -ernment will not only cheerfully comply with the request I have thus made, but that they will proper also tojsxamine! ful regard to the rights of the United States, j and to the maintenance of the good rela tions! between the two countries. -Such relations are always difficult and delicate in States that are adjacent to ,each other, without being’ separated by impassable; barriers. \ ;; '; For this reason it would be very gratify- ; ing to the President,’if you should be able; to give me an assurance that the execution of the sentences, pronounoed upon convicted persons, will: be suspended if occasion for -delay* may arise, in the manner before men-! tioned, to make it desirable. It, is theopin-; ion of this Government that sound policy, - coincides' with the best impulses of a; benevolent nature, in recommending ten derness, amnesty and forgiveness : in such oases.'*. - - \ This suggestion is made with freedom and eamestnesß, because the same opinions were proposed tons in our recent civil war, oy all the Governments and publicists of Europe, and by none of them, with greater frankness and kindness than by theGo vemment and statesmen of Great Britain. I am very sure that yon will find that these recommendations of a .policy of clemenoy and forgiveness in the case of the parties concerned are in entire harmony with all the suggestions and representations which this Government has made to her Majesty’s Government in regard to the aggressions which have been, made on the Canadian frontier, and that'they are also in harmony with the proceedings which this Govern ment has thought it just, wise and prudent to pursue in regard to the -violation of its own neutrality which was involved in those aggressions. , --- I have the honor td be, with the highest consideration, sir, " Your obedient servant, William H. Hexlean Affaire, Washington, October 28.— The Mexican Minister has received despatches from the city of Puebla,' Mexico, containing the offi cial report of the battle of Ixmiquilpatn, ■where the Belgian Legion was entirely cnt to pieces. Col. Vandersmissen, with the Belgian command, attached Ixmiquilpam, a place thirty leagues from the city of Mexi • co, and was defeated by the Mexicans. The Xiegion lost twenty officers killed on the spot. The Legion retired to Tnla, leaving their artillery and trains in the hands of the Mexicans.. Their officers who survived that battle have since embarked to Yera •Cruz for Belgium. - The following is a trans lation of a letter received here to-day: Yeba Cbtjz, Oct. II P. M.—The St. Na aaire, steamer, arrived here early this even ing, Gen. Castplnau being on board, His instructions are to send to Prance, in two detachments, all’the troops’ that are here. He brings besides a message from; Napoleon to Maximilian, advising him to abdicate in favor of anybody he-.pleases, and to go home. He is authorized to offer Maximilian the protection of the French flag, with a view that he may return safely to Miramar. The Marquis de Gallifet has no mission of any kind, and he only Comes to join his regiment and .return to Prance. General Bazaine comes to Puebla to meet General Castelnau. The General feels very sore against Maximilian for the very discredit able reports that the Empress Carlotta has spread in Europe. San PbanoiscOj Oct. 27.—The French commandant at Acapulco, it is said, has received orders to evacuate that place when advised of the evacuation of Mazatlan, which was to take place on the 15th inst. and to destroy the stores and supplies which he could not remove. A part of the French fleet would go to Tahiti, and the rest to South America. The wounded in the late engagement had been sent to France, via Panama. ; The Frenchfleet at Acapulco had. re ceived three hundred 10118 of coal from San Francisco. i: Morelia, the . capital ' of Miohoacan, was closely besieged by i the . Republicans, and the garrison reduced to great straits. Money iB in demand here at li per cent, .
