AMENDMENTS TO THE TAX BILL. Changes Interesting to the Public-Burn ing Fluid, goal oil and Gas.- razatton on Men's, Women'. and Children's Year -What oar Smokers and Chewers mast pay-Important to dterchauts,.Bankers mud Brokers-Impost on Banking As seciallonsote. • The amendments reported from the Senate Committee on Finance to the House Tax bill are numerous. The following are some of the most material changes, namely: A tax of five cents per pound on cotton: im perfect or incomplete lista may be corrected , by the assessors at any time within two years; to strike out the - tax - of $2O on those distilling or mamaiscturing less than. 50 barrels per year, from apples, grapes or peaches. The nineteenth clause of the tax schedule is altered as follows: Coal oil dis tillers and distillers of burning fluid and carnal ine shall pay $5O. Any person, firm or corporation, who shall refine, produce or distill petroleum or rock oil, or oil made of coal, .asphaltum, sale, peat or other bituminous substances,or shalt manufac ture illuminating oil; hall ,be .! regarded as a coal oil duitiller. The tax imposed upon the manufatture of it tobacco, snuff and cigars shall be neld to retcrue upon the sales or removal from the .., place of manufacture. All gas. companies . .i!A whose price is fixed by law,--are authorized to add the tax herein imposed to the , price per thousand feet on the gas sold; provided that coaltarand amrnordacalliqUorprodueed in the manufacture of illuminating gas and' the product of the distillation of coal tar arts the products of the manufacture of ammo niacal liquors thus produced shall be exe :apt from duty. On sulphate of berYtes, a tax of latents per 100 polinds. Strike otit the tax of 5 cents per gallon on wine made or grapes - further advanced than juice or must. Boot or shoemakers making ,boots - or: shoes. to order as certain work only,' and not for general sale, and whose annual pro duct does-mot exceed $2,000; are' exempt from taxation. On — feedy-Tmade clothing gloves, mittens, moccasins, baps, felt hats, and*other articles of drese for the wear or men, women and children, not otherwise assessed and taxed, a • tax of two per cent.* ad valorem, to be paid ny every person manufacturing or providing them for sale, cir•furnishing the materials and employing . others'to make, manufacture, or produce thee; provided, that any labor of any person making glove; mittens, moccasins, caps, felt hats, or other articles of dress to order, as custom work only, and not for general sale, and whose annual profits do not exceed $2,000, shall be exempt from tax, and articles of dress made or trimmed by milliners or dress-makers, for the wear of women, and children, shall also be exempt from this tax. Leine cut shorts are included in the tax of 30 cents per pound; on smoking tobacco of all kinds, not sweetened nor stemmed, nor butted, including that made of stems, or in parts of stems and imitations thereof, a tax of 15 cents instead of 20 cents per pound. On all cheroots, cigarettes, or cigars, the market value of which is over $B, and not over $l2 per thousand, a tax of $lO per thou sand instead of $4. On all other cigarettes, - cheroots and cigars, a tax of $4 per thou sand; provided that upon all imported cigars and cheroots, but not including cigarettes, an internal revenue tax shall be tevied and collected in addition to the duties paid upon the importation thereof of $lO per thousand, and stamps denoting the payment of such tax,shall be appended to every boxor pack age of imported cigars or cheroots before the same are sold or offered for sale; and any cigars or cheroots se< imported, which shall be sold, offered .or exposed for sale without having stamps affixed,shall be for feited to the United States, and the importer of such cigars or cheroots shall be deemed the manufacturer thereof and shall be sub. ject to all theduties, liabilities and penal ties imposed by law upon the manufacturer of domestic cigars and cheroots. That section 98 be amended by striking out all after the enacting clause, and insert ing in lien thereof as follows:—"There shall be levied, collected and paid on all sales of real estate, goods, wares and merchandise, and articles or things at auction, including all sales of stocks, bonds and other securi ties, a duty of one-tenth of one per cent." Strike out from the clause taxing sales made by brokers, banks or bankers, foreign ex -change or uncarrent money—"when the gross receipts of any bridge or toll road for and during any term of twelve consecutive calendar months shall not exceed the ,--. amount expended during the said term to - keep such bridge or road in repair, no tax shall be assessed upon such receipts during the month next following such term; pro vided the tax may be added to the rates of fare." Strike out the proviso "that any bank ceasing to issue notes for circulation, and which shall deposit in the Treasury of the United States, in lawful money, the amount of its outstanding circulation, to be redeem ed at par under such regulations as the Secretary of the Treasury may prescribe, shall be exempt from any tax upon such circulation," .and insert the following:— Whenever any State Bank or banking as sociation has been or shall be converted into a National Banking Association, or has ceased its usual banking business, in cluding the making of loans and the re ceiving of deposits, shall be assessed and collected in addition to the taxes already • imposed, a tax of one-quarter of one per cent. each month upon tne average amount •; of the circulation outstanding in any such ' State Bank or State Banking Association." Strike out the proposed' amendment to the .one hundred and sixteenth section relative to incomes, and insert after the words in the law as it now stands in the excess over $5OO the following, "and a like tax shall be levied and collected and paid annually upon the gains, profits and income of every busi ness, trade or profession carried on- in the United States by persons residing without the United States, and not citizens thereof." The term money, as used in this bill, shall ' be held to include drafts and other instru,- snents given for the payment of money. Amend schedule B, by inserting under the head of "contract," after the words, "for -such note or memorandum of sale," the following, "bill or memorandum of the sale or contract for the sale of gold or silver bullion, foreign exchange, coin, unourrent --money, promissory notes' or other securi ties shall pay a stamp duty at the rate pro vided in section 99." That section 171 be amended by adding • the following proviso : "That no claim for drawback on any articles of merchandise exported prior to June 30th, 1864, shall be allowed, unless presented to the Commis sioners of Internal Revenue within three months after this amendment takes effect." That section 6 of the Internal Revenue bill be amended, striking out all after the enacting clause and inserting "that every National Banking Association, State bank or State banking association, shall pay a tax of two per cent, on the amount of notes to any person, State bank or State banking institution, used for circulation, and paid out by them after the Ist day of July, 1867; and such tax shall be assessed and paid in such manner as shall be prescribed by the Commissioner of Internal Revenue. That Section 14 of the same act shall be amended by striking out all after the enact ing clause, and inserting in lien thereof the following: Sac. 14. That the capital of any State bank or %State banking institution, which, has ceased or shall cease to exist, or which has been or shall be converted into a - National bank, for all the purposes of the act to which this is an amendment, shall be as. sumedlcb be the capital as it existed, imme diately before such bank ceased to exist, or `was converted as aforesaid; and whenever ;the outstanding circulation of any bank, association, corporation, company or person • shall be rsdnced to an amount not exceed- ing five percent. of the chartered or declared capital existing at the time the same was tissued, said circulation shall be free - from taxation; and whenever any . bank which lhue ceased to issuenotes for Circulation shall deposit in the Treasury of the United States in lawful money, the amount of its outstanding circulation to be redeemed at par under such regulations es the Secre . Lary of the Treasury, shall ; prescribe, it shall be exempt from any tax upon such circuit;- Lion: and whenever any State bank or banking association has been converted into a National banking association, and such National banking association has assumed the liabilities of such bank or banking as- - scciation, including the redemption of its bills, or by any agreement or understand ing whatever with the representatives of such State bank or . banking association, • shall use the bills of such State bank or banking association, such National bank , ing association shall be held to make the required return and - payment on the circu lation outstanding so long as such (Arcata lation shall exceed five per cent. of the 'capital before such conversion of such State , bank or banking association., ' That the act. of March 10*;188 , 4 to de ' clare the meaning of certain parts of the Internal Revenue act, be - amended by striking out sections 3, 4 and 5, and insert ing the following : "That it shall be the duty of all persons required to make returns or lists of revenue, income and articles or objects charged with an internal tax, to declare in such returns or lists whether - the several rates and amounts therein contained are stated ac. cording to the value in legal tender money." Include in the free list the following: Pruesiate of potash, retorts and tiles of clay, • staraped copper, cottons, deerskins, smoked ;or not, oil dressed; India rubber springs, ;used exclusively on railroad cars; iron drain and sewer pipes; cordage, ropes and cables, made of - vegetable fibres,peat; wrap ping paper of all descriptions, and tarred 'paper for roofing and other purposes; fish 'plates, *saltpetre, safes, looms, spinning ma chines, pumps, steam ertgines,hot water and hot air furnaces and sewing _machines, spokes, hubs, bows and felloes, wooden tanks and cisterna,.for crude mineral oil; rail made and fitted for railroads; adgar from corn; -flowers of sulphur and sulphur `flour; plants, oils and spices; wine mule of b grapes, currants, or other fruits, and rhut-, arb. The Financial Committee propose to strike out from the proposed free list iron bridges and castings for bridges, reapers, mowers, threshing machines and separators, corn shellers and woodware, sulphate of barytes. All articles sold, given, purchased, re ceived, Made, manufactured, produced, branded, stamped or marked in violation of the provisions of this bill shall be forfeited. If any person shall carry on the business of a distiller or rectifier without having paid the special tax, he shall pay for every such offence a fine not less than double the tax imposed upon the spirits distilled or double the special tax due for the spirits rectifieo by such persons or found upon the premises. The committee propose the following pro viso to the thirty-first section of the bin in relation to bonded warehouses: Provided, That any article manufactured in a bonded warehouse established under the one hundred and sixty-eighth section of the internal revenue act of Jane 30th, 1864, and located in any of the Atlantic States, may be removed therefrom for transporta tion to a customs bonded warehouse at any port on the Pacific coast of the United States for the purpose only of being exported therefrom under such rules and regulations, and upon whom the execution of such bonds or such other security as the Secretary of the Treasury may prescribe. Every person making or distilling spirits shall daily make an entry in such form as the Commissioner oflntarnal Revenue shall prescribe, of the number of pounds or gal lons of materials used, the number of gal lons of spirits distilled, the number of gal lons placed in warehouse, the price thereof, and the name and place of business of the buyer, and shall, on the Ist, 11th and 21st of each month, or Within five days thereafter, render to the assessor or assistant assessor an account in duplicate with all particulars and verified by oaths, -and also a copy to the collector, and the entries shall be veri fied by oath of the person making them, in the presence of the assessor or assistant as• sensor, who shall append a certificate of the execution of the same, and the distiller shali make the following oath :—"I do certify that to the best of my knowledge and beliet the foregoing entries are just and true, and that I have taken all the meansin my power to make them so." - The books of entries shall be kept open' to the inspection of the assessor, and a viola tion of this provision renders one liable to a fine of five hundred dollars; and a false account shall be punishable by a similar fine and imprisonment. There shall be levied, collected and paid on all distilled spirits that may be distilled for consumption or, sale of first proof, on and after the passage of this act, a tax of two dollars on each and every proof gallon, upon which no tax has been paid according to law to be paid by the distiller, owner or any other person in possession thereof, and the tax shall be a lien on the spirits distilled, on the distillery used for distilling the same, with the stills, vessels, fixtures and tools therein and the interest of said distiller in the lot or tract of land wherein said distil. lery is situated, from the time said spirits are•distified until the tax shall be paid. The committee propose to strike out the proviso imposing $l5O per gallon on brandy distilled from grapes, apples or peaches. They propose to amend the twenty-fourth section of the bill by adding " and upon spirits removed under bond, for the purpose of being re-distilled or rectified, and upon which an allowance shall . have been made as herein provided, the duty upon such al lowance shall be paid, together with the du ties imposed by law upon Said spirits, in case such spirits shall be withdrawn for con sumption, sale or for transportation, without being exported. The corn mitteerecommend a provision for feiting spirits which shall be changed in cha racter either by rectification or mixing after they have been duly rechecked and branded and exposed to sale, without being properly branded s and forfeiting such spirits if brand ed illegally, without the taxes on them be ing paid. A. new section is propTged, viz—Any per son who shall remove spirits elsewhere than into a bonded warehouse, shall be liable to a fine of double the amount of tax, or im prisonment for not less than three months, and the spirits removed shall be forfeited, seized and sold, and any one who shall aid or abet such removal, .shall be liable to a fine of 8200 and imprisonment for three months. A provision is inserted, authorizing the Commissioner of Internal Revenue to exempt distillers of brandy from apples, peaches and grapes from such of the pro visions of this act as he may deem expe dient. The amount paid into the Treasury on account of stamps shall be included in estimating collector's commissions. A manufacturer of ale or porter may remove one hundred barrels at, a time by a permit from the Collector. - A new section provides against bribery, a penalty of three times the bribe. and im prisonment for three years, Among other amendmente to the section reorganizing the Internal Revenue Bureau by the committee is tine raising the salary of the Commissioner to $6,000 per annum.
