mittee felt that to Mr. Maguire's manage
ment was owing to the ill odor into which
the High School had fallen. He desired that
on the third Tuesday of next month a spe
cial meeting of the Board be held, and the
evidence be printed.
- . Mr. Money, of the Twenty-sixth, desired
.that,Mr. Magtdre should be present before
the - committee. , -
Mr. Freeborn said that Mr. Maguire had
beennotified thatthe examination was about
to be made, and he had not been present.
Mr. Mclntyre wanted to know how the
_charges had been made, and at whose insti
.gittion.- There was something in the matter
that he couldn't understand. The speaker
did not approve of the manner in which the
Iriglifidiool had been conducted of late, bat
be didn'tl like the ;proposed method of
`remedying the evil.
Mr. Scheide moved as a substitute for the
resolution as above, that a special commit
tee be appointed to examine into the affairs
of the High School,and to report at an early
day.

This was withdrawn.
Dr. Nebinger slefended Mr, • Maguire,
charging the committee With' - holding star
chamber proceedings.
The Chair called Dr. Nebinger to order,
protesting against porsonalities'of any kind.
Mr. Freeborn denied every word asserted
by Mr: Nebinger as to , the secret character
of the sessions of the committee.
Mr. McManes did not know Mr. Maguire,
"Suchwanted to have him present when
Such testimony is again taken. The speaker
would not sustainproceedings of this ex
parte character. If Mr. Maguire is the
wrong - man for the place then he should be
ttlintid'out. '
Mr. Freeborn said that the character of
the testimony had been made known to
him. =Re could have been present if he de
sired. He never asked a question
about it, simply saying that the same men
who now'reprehended him applauded him
before.
Mr. McManes said he had read a portion
of .thelestimong taken, and if it were true
he would - vote to put him out. - But he
wanted Mr. Maguire to be present and have
a chance to defend himself.
Dr, Nebinger said that if after a special
examination at which Mr. Maguire was
present, he found that the prejudice against
the High School was the fault of Professor
Maguire, then he would say, in God's name
let him go out from it !
Mr. Rittenhouse said that four years ago'
'a special committee held twenty-five meet
ings, and reported against Mr. Maguire,
that the interest of the institution required.

Mr. Elkin declared that the devotion
given to the High School by Mr. Freeborn!
was beyond all praise. No gentleman:
-could- be more devoted to its interests.,
Though a member of the Leg,islature, he,
••never missed a meeting of this Board. He
could not be charged with prejudice, nor
could the. motives.of any of the committee
be impugned.
The resolution to refer the report.to a spe

SacTraN L The Select and Common Councils of the
City of Philadelphia do ordain, That all the payment;
to be mode under the contracts to be entered into by
virtue of the ordinance entitled "An ordinance to
authorize the Mayor of the city of Philadelphia to
oontract for thenleaning of the streets of the city,"
approved March 2,1866, shall be payable in warrants
drawn by' the Idayor upon the City Treasurer, In
equal monthly installments; and one-tenth of the
amount of eacn:of said monthly instalments shall be
retained by the city to baappropriated as hereinafter
directed. Provided that wnen the sum so retained on
each contract shall amount to tive thousand dollars,
the remaining payments may, at the;option of the
Mayor, be paid in full as they shall thereafter become
Sac. 2. The Chief Inspector of Streets shall overlook
and supervise the work of the contractors, and report ,
any neglect, on-. their part to the illayor„-,and to the
.Committee on Street Cleansing; and notifythe contrac
tor or contractors of iris or their neglect. If after such
report and notice. the _contractors, or any of them,
shall not immediately remedy the complaint, the
Committee on Street uleanelng, may direct the Chief
- Inspectorof Streets to - perform the work - at the ex
pense of the contractor or contractors in, delimit, the
cost of performing the—same to be paid out of the
amount heretofore authorized to be retained. and the
- Mayor Is hereby authorized to draw warrants for that
purpose on• presentation of. the bills 'therefor by the
• Chief:lnspector of Streets: .•
