    The Givert Contested Election Case.
Ile Given and Weaver contested election
rase is now in the ;hands of an examiner.
ThP Court of Common Pleas appointed (len.
C. H. T. Collis, with powers to receive testi
mony. Yesterday, in the office of the ex
aminer, the case was partially heard. The
evidence occupied four hours, and was as
follows:
James W. Piavell, a witness on behalf of
the contestant, sworn—l was a member of
the 19th Pennsylvania cavalry; I am not
now; was discharged in November; belonged
to Co. B; was a private; the, regiment left
Baton Rouge on the 2d f August; butl re
inained there, ondetached duty, until the
latter part of October, hen I was ordered to
General Sheridan; the camp of the regiment
was within a square of my quarters up to
the-2d of August; February sth, 1864, the
regiment was consolidated into six compa
nies; the next consolidation was at Baton
Rouge, in August, 1865; at this consolidation
there were about 200 men in- the regiment;
the sick and wounded numbered a third
more; on October 10, 1865, I was detailed at
Baton Rouge as clerk; the regiment was not
in or near that point, not within 1,000 miles
of it; there were then only two men of the
19th cavalry there; they were Hyzer and
:myself; on the 10th of October the 'officers of
Co. B were Capt. Frank Reeder and Lieut.
Joseph C. Castle; Reeder was acting Lieu
tenant-Colonel; we had no second lieuten
ant; John Wilson was not an officer of the
company, nor had we any private of that
name; William Downey was orderly ser
geant when the company lett Baton Rouge;
Henry Lee was not an officer of Co. B; there
was no such man in the company, nor was
William Smith nor Henry Moore; I know
of one Cook, a corporal in Co. I; never heard
of William Reynal or John M. Munch;
there is a Hicks, an'orderly in Co. B; a Ser
geant Wilson.was in the regiment, but not
in Co. C, and he was mustered out shortly
after•the regiment left Baton Rouge; there
was no Robert Anderson or Christian Blu
thard, or David H. Lane, nor Daniel Far
ney;' I know one Smith, but his name was
not William; never heard of Maxendrey
Rercher, nor James L. Wagner, nor John
Wilson; never had but one Wolf in the
whole regiment, and he deserted at Union
city in 1862; looking at the return for Co. B,
19th Pennsylvania Cavalry, I find the fol
lowing names of men who belonged to Co.
B on that day: Augustus Strickler and John
Mulholland, sergeant; when Co. Bleft Baton
Rouge it was 60 strong.
Cross-examined—l had notification that I
was not consolidated into Company B when
I arrived at Cairo, about a month after
wards; I joined Company B at Baton Rouge
in August following; Sergeant Downing
kept the company roll; I was in camp every
night; after they left and went up Red river
I knew nothing of them.
Re-examined—On the 10th of October
none of the company headquarters wer6 at
Baton Rouge ; there was not a cavalryman
within twenty miles of the place ; there was
no election held in October last in Baton
Rouge ; there was a post office there, and a
hospital with soldiers in it, but only four or
five of our men.
111,Charles A. Dnnkelberg, a witness called
by Mr. Weaver, sworn—Am captain of
Company C, 2d Pennsylvania Veteran Re
serves heavy artillery; have reported here
by order of the War Department; my com
pany is now three miles from Petersburg;
have been captain twelve months, enlisting
in 1861; we were in Petersburg after the 4th
of April, 1865; the company at first num
bered 130 men, now I have 113; on the 10th
of October I had a few men more; it was
recruited in Wayne county, but since re
cruiting I have had new men from all parts
of the world; John Yeager was not an offi
cerT of the comps ; a man of that name had
been discharged wo years. before; Charles
Howe:N.7BS never officer of the company;
he was a private, nd was discharged twenty
months ago; W' William Snyder and Joseph
Bishop were not officers; there were privates
of those names, but both were discharged a
year ago; my company never was at
Burkesville; looking at the election returns
for my company I recognize Charles Howe,
James Snyder, John Yeager, all discharged
a,
.yeaj• before; Joseph Fisher, who was
absent, sick, on October 10th; Stephen
Brown, wild was in Surrey county, forty
five miles away; John W. Mung, who de
serted four years ago; Fred. Willie, George*
Wilhelm; Nicholas Sehup, Isaac Shelley, all
• discharged a year ago; Henry Geaha was
with the company only four weeks. John
.Harvey was discharged in July, 1865; Peter
Wirum died in fall of 1864; John Johnson
died four years ago; Casper Schaff is with'
the company; James Weaderwork was in
-%urrey comity, Va., on October 10; John
Ottens was in Surrey county.
The captain thus specified every 'name on
the roll, all of whom were discharged, some
two and three years ago. He resumed his
testimony by saying that there was no elec
tion in his company on October 10. Two
gentlemen came to the camp and asked' to
open a poll, but permission was refused, as
only five. men were in camp; I told those
five to go and vote with Company K, if they
wanted to, but only one, William Nelson,
went; he, Lieut. Sheets and myself were all
the votes of my company; we voted with
Company K.
Cross-examined—Surrey county is not in
the same direction as Burkesville; four of
our companies, D, B, A and I were there on
the 10th October; I had twenty men on de -
stached duty at Surrey county; my company
was detached at different points.
George N. Doolittle sworn—l live in Fac
tolyville, Wyoming county; was First Lieu
tenant Co. I, 3d regiment Pennsylvania
veteran heavy artillery; was mustered out
Nov. - 13, 1865, but was with company on 10th
of October. The company was in the city
of Richmond in barracks; before that we
were stationed in the outskirts; we went
there in April; the company was together
with few. exceptions; a private, Robert J.
Murphey, was in my company, bat not
present on October 10; Thomas C. Jones was
present; a Wm. Smith was also; there was
xto such name as John W. Taylor; I know
the names of all the men in my company
present on the 10th of October, but not of
.all those who did not belong to the company. ,
The roll was handed to witness. He picked
out a score of names; nearly all were.deser
ters, who had left in,the spring or fall of
1864. The Lieutenant closed by testifying
that therewas no election held in his com
pany on the 10th of October. I was with the'
company all day. Twenty-five or thirty
men were messengers for Gen. Ord's head
-quarters in another part of the town.
The examination here closed.
,Skating in Canada.7"l4kating Rink" in
Montreal—The Rreservation of Ice.
The best classes of, the people in the larger
towns of Canada do not usually skate in the
.open air, but during the past few years have
been building what they call "rinks" or
skating-houses, which they use instead of
ponds or lakes. The advantages of the
rinks" are, apparently, that they facilitate
- the production of ice, the Urger being of but
little depth, and as the ice is covered, it is
protected from the; rain and snow storms
which tend to destroy it or'rerider it useless.
'Thus the ice may be kept better and longer
than it could be without the house. There
are many rinks in Canada and one!or two
in the United States. The best are in Que
bec and Montreal. For the purpose of
ing our readers some idea of "rink" skat
ing, we copy from the Montreal Gazette an
account of skating in Canada: • .
• This popular; winter amusement ofnearly
all classes in a position to pay a share of the
expenses °fa rink, broke . out in its present
form among the gay belles of Quebec, in Air
-about the year 18.53. It rapidly extended
•; throughout the province—ultimately grow
ing to the proportions Of an extensive earn
mercial undertakinz, in which, of course,
the social element predorninated. The la
dies of Quebeaoriginelly skated' on a space
enclosed within one of the wharves'on the
St; Lawrence,wb ere, - from the nature of tht)
place, they were subjected to much incon
venience, "outsiders" frequently rushing in
with all the hauteur and self-importance of
the true born American, and disturbing
many a little manoeuvre intended for the
entrapment of some promising commercial
bejeweled and bewhiskered D'Orsay, or
some gruffer and larger pedigreed marching
lieutenant. Some of this bevvitchingness
could not well be thrown away on an
intercepting stevedore, or aimed at the
susceptible heart of the unfortunate
fellow who scudded about on borro wed
skates, and a change for the better was
therefore determined upon at a.. coun
cil of war, in which some of the
pettiest heads in the city solemnly came to
gether, and finally hit upon the exclusive,
but necessary and convenient scheme, since
so successfully carried out. "Rome was not
built in a'day," and neither was the rink
of the present period. It rose to its present
proud shape from a very humble begin -
ning—a ham-like shed run up in a hurry,
and dingy, narrow and obsdure, which was
erected outside of St. Louis Gate, and was
irreverently called the "cattle shed." Tne
fair dames, the portly matrons and the
sylph-like damsels, who gyrated in it on
"the light fantastic toe," had long ere this
invented the Bloomer costume, and fear
lessly claimed it as their own when accused
by a bold, shameless bachelor of our ac
quaintance,,with copying Miss Lucy Stone's
toilette. They were not evidently ashamed
of the proportions of their :ankles, and all
through the movement displayed a courage
and power of invention truly masculine.
The original rink had primitive windows
on a level with the ground, through which
the gamins of the town would peep to
see "ladies and gentlemen skate in a
house ;" and every now and then would
shout, -"There goes the girl with the
golden boots," "Look at that swell with the
hi-glass," "Here comes the. belle with the
feathers," the basso profundo of an attendant
portly Aergeant breaking in every now and
then with, "Clear out, boys, or I'll .put
some of you in chokev." So much for a
beginning ultimately and shortly destined
to lead to the erection of palatial edifices
over half a continent, in which the msrry
game of the rink could be played by night
and by day, and the arts of the drawing
room displayed on a field calculated to
attract and dazzle unwary bachelors.
Montreal, Boston and Halifax, soon followed
the example of Quebec, the first rink erected
in the city springing into existence in 1559,
the year in which the Montreal club erected
its building on Upper St. Urbain street.
Since then the Victoria rink has been con
structed in a style and manner which far
distances all other edifices of a siamar
character, and there is every reason fur the
belief that henceforth the "institution" will
be a permanent one, a knowledge of skating
being fully as essential to a lady as the
gentler but less healthful "practice" at the
piano or the accomplishments of social life.
VICTORIA SKATING RINK OF MONTREAL
This rink was constructed during the sea
son of 1862, and was first opened to ic.s sub
scribers as a club, for use on the 24th of
December of that year. An act of incorpo
ration was obtained, wader which the club
holds and manages its real estate, ofa value
now of about $30,000, while the capital stock
is kept within the limit of 300 shares, of $5O
each; or $15,000.
The building is situate on Drummond
street, on a lot 120 by 227 feet. 'rue area
for skating is 202 feet by 80 feet wide.
covering a space of about 16,C00 square feet.
This is spanned by a semi-circular framed
roofing, rising to a height of 52 feet, and
constructed in such a manner as to give an
apparent lightness of effect, combined with
strength, the arched principals of the roof
spring immediately from the ground. The
skating area is surrounded on all sides by
a platform ten feet wide for promenading,
and in the centre of one side is a recess in
which, extending over the' platform, is a
handsome and commodious gallery for the
music, which is supplied weekly by fine
military or other bands.
The rink is lighted during the day by
large windows on three sides, and at night
by six pendant rings or stars,each contain
ing forty-eight burners, and by a bracket
light attached to each of the principals of
the roof, containing in addition one hun
dred and ninety-two burners, making with
those in the orchestra some five hundred
jets, by which the building is brilliantly
and effectively illuminated.
There is also a small gallery at the west
end, over the entrance door, from which
an excellent view of the whole may be
obtained.
The building is entered by a spacious
hall, on each side of which, and opening
on the platform, are separate dressing
rooms for ladies and gentlemen, with hat
and cloak rooms attached. These rooms
are furnished with numerous boxes, each
with lock and key, and of sufficient size to
hold the skates, boots, &c. They are also
warmed and thoroughly comfortable.
The superintendent lives an the premises,
occupying rooms over the entrance hall.
The business of the Victoria rink is man
aged by seven directors, choSen annually by
the shareholders,and all applications for ad
missions as annual subscribers are made to
and determined by the directors. The skat
ing season opens about the middle of De
cember, and continues almost uninter
ruptedly for four months, the rink beinc ,
opened for use from BA. M. till 10 P. M.
Skating has been enjoyed as far on as the
15th of May.
Fancy dress entertainments take place
two or three times during the winter, and
are thronged by enthusiastic skaters, with
their friends as spectators, numbering in all
some fifteen hundred or two thousand per
sons. This stirring crowd, the inspiring
music, brilliant lights and extra illumina
tions produce a very fine effect.
