The following is the decision rendered by 3 a Aft
Grler on the twenty-second (U2) dny of September,
Jm, in the United States Circuit Court at Phlladel-
Shis. The case was argued three days bv Charles
I. Keller or New York, B. t. Lacas and S. A. Pur
vmnce of Pittsburgh, for defendants, nnd George
Harding of Philadelphia, and George U. Christy, o.

OPINION OP JUDGE GIUER
As I write with difficulty I can only Mate the con
elusions to which ray mind has come after a carefu
examination of this case. I
Ttiu complainant has exhibited a patent dated
ttth of April, 1SII6. This is prima facie evidence 01
a Kood title, aud puts on the respondents the bur
dsn of proof that the patent Is void or worthless.
I need not repeat my remarks In the cuse of Good
year vs. Day (i Wall, C. U. Kep; 1KB,) but now
adopt them as allurdiuK a rule ol decision which ap
piles clearly to ttic present ewe.
As the infringement of the patent la admit ted,
the only questiou'will be-as to tho validity of cum
ylainants patent of April 83,1858.

pedo, aud signed by an officer of the Company, so
