OPINION OP JCDGB GKIEtt.
An I write with diltlcnlty I can only Mate the con
elusions to which my mind has come after a ciirein
exainiuation of this ciise. I
The coni'ilainuut ha exhibited a patent dated
iutli of April, ldliS. This is prima facie evidence of
a good title, and puts on the respondent the bur
den of pro'if that the patent is void or worthless.
1 need not repeat my remarks tn the case of Good
jwirvs. Day(i ttall.-C. C. Kep; sal.) but now
adopt them as flordiiu a rnlo oi decision which ap
plies ciearly to tne present cso.
As the infringement of thu patent Is admitted,
the only question will bo as to the validity of com
plniuants patent of April !i, ism.
It was after speculation had been reduced to
practice,-' and alter ropoated experiments, that the
complainant succeeded in overcoming-lie prejudice
and ignorance of the people on the cubfect, and
persuading the public thai his invention was useful
after he had established its great utility and v.iiue
and "when his genius and patient perioverance, in
pile ol sneers and icon's," wjre completely suc
cessful, that Iteed, who had before made experi
ments on the s:ime subject, and was unsuccessful
liinuriued that he h:id tile best ifcjht totlieinvenliou
a id after purchasing one or more complainant's tor
pedoes, he applied on the 1st or November, ISliT,
i.r a patent lor snbstautially the same combing
Hons of devices and uacliiun contained in complain
ant's pateut. On the 15th of the same month the
wpondents formed themselves into a company or
torpomtiou called "The Keed Torpedo Company."
ior the purpose of 'pirating the complainant' in
.ve.ition. and atippartins tl expense of litigation,
iind thus defraud him of the fruits. They have uer
HCvered. even after) the preliminary injunction very
property granted by the District Judxe.
Let a ducrue be entered for complainant for a per
petual injunction, and a Master appointed to Lake
