36th of April, 18 i6. Thla is prima facie evidence ol
a good title, and pnta oo the respondent the bur
don of pro if that the intent la Told or worthless.
I need not repeat my remarks in the case of Uood
yaar v. Pay ('2 Wall, C. a Hep; soM.) but now
adopt them as affording a ruloi decision which an.
pile clearly to the present ctae.
As the infringement of the patent la admitted,
the only question will bo aa to the validity of com
plainants patent of April Itt, law.
"It was after speculation hid hocn reduced to
practlco," and alter repeated experiments, that the
complainant succeeded in overeoailnir'he prejudice
and fguoraiice of the people on the sulifect, and
persuading the public tbiu his invention ivas useful;
after he had established Its great ii'.llltr and value,
and "when hia eenius atid patient perseverance, Iu
spito of sneers and scot)-," were completely suc
cessful, that Heed, who had before made experi
ments on the same subject, and was iuiiucco.-fiil,

pedoes, he antriied on the 1st of November, 18i:i,
for a patent for substantially tho same combina
tions of devices and mat lilne contained In complain
ant's patent. On the 18th of tho same month the
respondents formed themieives Into a company or
corporation called "The Reed Torpedo Ckiinpaur,"
for the purpose of pintin? tho complainant's in
vention, and supporting the expanse of litiiration,
and thns defraud him of the fruits. They have per
severed, even after the preliminary Injunction very
properly grunted by the liistrict .ndgo.
