ailopt them as affording a rnle ol deciiion which ap
plies clearly fa the preeant oaae.
Aa the Infringement of the patent la admitted,
the only question will bo aa to the validity of com
plainants patent of April 15, 1868.
"It waa after speculation had been reduced to
practice," and alter repeated experiments, that the
complainant succeeded in ovcrcomfng-he prejudice
and ignnranre of the people on the subject, and
persuading tho pnhlic that bis Invention wasoaeriil;
after he had established Its great utility and value,
and "when his gen'm and patient pcrsovemnco, in
apite of sneer and scon," were completely suc
cessful, that Heed, who had before made experi
ment on the same subject, and waa unsuccessful,
im-iirfnod that he had the beat itaht to the Invention,
ntid after purchasing one or mora complainant's tor
pedoe. he applied on the 1st of November, MOT.

respondent formed themselves Into a company or
corporation called "The Reed Torpedo Companv,"
for the purpose of pirating tho complainant's 'in
vention, and suppnrtinz the expense of lltiirntlon,
and tints defraud him of the fruits. They have per
severed, even sftir the preliminary Injunction very
properly granted by the District .Indite.
Let a decree he entered formmplafnant for a per
petual Injunction, and a Master appointed to take
an account according to the prayer of the bill.
