OPINION OP JTDCiE GK1E1S.
Ai I write with difficulty I can only state the eon
elusion to which iny mind has come' nfter a careltt
examination of this case, ,,.. J
The complainant baa exhibited a pntentf dated
2.1th of April, lst5. This Is prima facte evidence ot
a irood title, and pitta on the respondents tho bur
den of proof that ttie patent is void yr worthiest.
I need not re at myloniarks inllie caseof tiood

adopt them as allot-dina a rule ol decision widen ap
plies clearlv to the present cine.
A the infriiicemcnt of the patent la admh ted,
the only question will be as to the validity of com
plainants pateiit of April 33,1858. .
"It was alter speculation had been reduced to
practice." and alter repeated experiments, that the
complainant succeeded in overcoming he prejudice
and iunomnce of the people on the subject, ' ami
por'lia.!iriir the public that Ills invention w as use'i:l;
after he had established its great .utility and value,
and "when his genius and patient perseverance, In
spite or sneers and seotl's," were completely suc

ments on tUc same subject, and was unsuccessful,
Inis'dncd that he had the best right tiitlieinvn:lon,
and after purcluuing one of more complainant's tor
pedoes, lie spoiled on the 1st of November, lsi-7,
for a patent for' substantially tho same combina
tions of devices and n achino contained in complain
ant'a patent. Ob the 16th of the same month the
respondent formed themselves Into a eominny or
corporation called ''The Beed Torpedo Company, '
for the purpose Of pirating the complainant's- in
vention, and supporting the expense or HlL-atlon,
and thus defraud him of the Iriiits. They have per
severed, even alter the preliminary Injunction very

Let a decree be entered for complainant for a per
petual 'nhinctlfHi. and a Master appointed to take
au account according to the prayer of the bill.
