The Court would say that if the killing had oc
curred In the first fight, It would have been
manslaughter, at least. The law trots each a
high value upon human life that there must be
Imminent present peril to the slaver's life or
limb In order to excuse killing. It there wee

slaughter. Mr. Miller claimed the whole thing
was one transaction , that the quarrel wag

the shooting. The defense sought to crtmloate

The prisoner could have avoided the killing; ho

One of the boldest, most extent,. robberies

The goods taken are supposed to have been
