Judge Stowe - overruled the motion for a now trial, stating brieflyi that after mature reflection, he was satisfied a the correctness of the verdict. AB to the cling° to be jury, the Judge remarked that I:helmet erred at all therein, he erred on the aide of mercy rather than otherwise. He could therefore see no reason for granting a now trial, and the uno. don was overruled. Mr. McDowell, being present in Court, was ordered to stand an, after which he was sen tenced to pay a fine of one hundred dollars and undergo an Imprisonment In the penitentiary for five years. The prisoner, it will be recollected, was tried for procurring an abortion upon the person of • Mrs Sophia Wolff, from the effects of which she oiled. There were several 'circumstances con nected with the case, which rendered •It pecu liarly aggravated. The doctor had the reputation of being a 'Mint physician and enjoyed alarge and lucrative practice. Hts victim was the wife of a soldier, and while he was absent to the ser vice of his country the defends= made her sc. crosintance in a professional capacity, and finally accomplished her ruin. Finding her pregnant, he resorted to Illegal means to hide his guilt, and by this means caused her death, and the death of his own offspring. The fact that he has a• wife living, (a most estimable lady, too,) also iggra rates his guilt. The doctor Is about fifty years of age, and bas many warm Mends, whe ex press deep sympathy for him. He received his sentence quite calmly, and had evidently been anticipating It.
