This morning, Judge Stowe delivered an opin
lob In the Welsh and Kelly behest corpus case—
the first case of the kind which has arisen under
the act rebating to the commitment of "profee
slot, el thievea" in this county. The judge do.
cldes that the defendants were Illegally commit
nil, inasmuch as they ! were not arrested at any
one of the place.' Specially designated in the act
of assembly, but in conseimence of developments
made upon the hearing to regard to the robbery
of Dr. McCandless, the court ordem that the
defendants both be held to answer that charge.

61,000 to appear and prosecute the ease. The
following Is the decision: .
This is a proceeding by habeas corpus under
the Oct of 13th of March, ISfid. and its supple
meut of 90th of March, 1503, relating to the ar
nst and Imprisonmem of professional thieves.
SECTION 1. "If any person Rhein be charged
on oath or affirmation before the Mayor (01. the
city of Pittsburgh) with being a professional
thief, and 'elm shall have beau arrested by the
feltee atitheritlee at any steamboat landing, rail
road depot, church, banking Institution, broker's
office, place of nubile amusement, auction room,
or crowd.' thorouzhfani In the city (of Pitts
burgh) end It shall he proven to the satisfaction
of said Mayor, by sufficient testimony, that he
or she was frequentreg such piece for an unlaw
ful propose, he or she shall be committed, etc."
The eierend section gives ta parties so com
mitted the right to apply to any Judge of the
Coact of the United States for a writ of habeas
corpus, and directs that on the ;mere thereof,
there shall boa reheating of the evidence, no
empowers the ledge either to modify, discharg
or confirm the commitment.
Several exeeptions have bean Liken to the
proceedings before the Mayor, all of Which we
deem immaterial, as involving matters• not the
subject of review litre. The sae comes before
us to be heard simply upon the erkterbee which
may tie produced, and if that requires that the
commitment be attired,. le other- words, satis
fies us that an offense under the statute it made
out, we must bold the prisoner 'as regardlesa of
any irregularity in the record of the Mayor's

time the officers arrived, In search of another
person suspected of larceny. We find no fault
with the officers, they did what they believed to
be their duty, well, and deserve eredit - for their
activity and pertinacity, But the act will not

standing we may be fully convinced from the
evidence that they are all they are sold to be.
They were not arrested In anyplace specified by

to prison. It is evident that a Hotel should be

Sunday Liquor Selling
It would seem that certain tavern keepers can
not main the temptation to sell liquor on San
day, notwithstanding thegreat Mau which they
are compelled to Tun In so doing. Warrants
hare been leaned Ihr the angst of William Chad
wick, of Grant street., and I). McDonough, of
the "Traveler's Home," Wylie street, charging
them with seWng liquor last Sunday. There
are warrants ant for the arrest of other parties,
charged with a similar erase. When a "raid"
is made upon them violators of law, they close
up for a time, and old topers find It a vary diffi
cult matter to get their accustomed "nlps" on
fanday, but as soon as the oviltement subsides -
they open up, etie.bY one, and there is free ac
cess through the back doors to the Initiated.
This is a difficult evil to contend with, and ro•
quires the strictest vigilance on the part of the
officers.
Fire at Turtle Creek.

hydrophobia.. Some weeks since a dog belong
