D. D. Norris testi fi ed that Sims had entered
his store, on Federal street, Allegheny, on the
evening of the murder; he had a knife In hi,

dently with the intention of cutting him ; the '

on Federal street, about 734 o'clock, on the
night of the murder • he wan under arrest at
the time, end behaved very rough.
John MeCtiestney, a night watchman in
Allegheny, testified that he had charge of
the Lookup on the night Sims was arrested ;
hi, whole demeanor indicated that he did not
realize the consequences of the charge for:
which he wan arrested.
Andrew Sime, brother of the defendant,
testilledho visited his brother in the Alleghe
ny watehhonse about eleven o'clock on the ,
night of the murder; he appeared slightly do
ranged,• and knocked his head against the
bars of the cell several times; did not talk
with him.
David Sims, father of the prisoner, testified
that the prisoner was eighteen years old In
December last; the first intimation he ever
had that his son drank liquor was when the
present diffieulty occurred; he had been on
the Provost Guard for six month', previously.
The testimony for the defense here closed,
and the Court adjourned until l 3 o'clock.

though not dated, was evidently Written on
Friday, the 13th, after the desperate and
bloody struggle of Thursday. We are permit

Yesterday our brigade was ordered to
charge the enemy's works by regiments. The

suffered severly. We retired about fifty paces
to a road which we hold.

Deserters Arrested
On Monday oMnr M. B. Hartsell and J
Bleier, arrested Mg, duerten from the 7t •

David Jericho. Tho deserters were arrested
at Six Mile Run in Lower SL Clair township.
On the way to the city, Plttlegion made •
desperate resistance, drawing his revolver
and fixing at the officer. Fortunately, how
ever, the shot did not take effect, and the re—

then drew& knife and made a whinge at the
ofßcor, but' as struck on the head at the Mlle
moment, with the butt end of a revolver, in
flicting • very severe gash on the left temple.
