The Date Habeas Corpus Case. . .
On Thursday afternoon Jade% Sterrett:
..., L: - , ileitamed the hearing of witnesses in the
Matter of the application of Mrs. D. M. Dake,
for • writ of habeas corpus to eompol Mrs.
Holmes and Dr. Cuthbert to produce the body

been sent, since the preliminary hearing, at
the instance of counsel for the plaintiff, and

which would be likely to follow his removal

this dootor away forthwith, but Mn. Holmes
• . , and , Dr. Cuthbert Interfered to prevent them,
• • '-iind' demanded that they should show their
written authority from Court before they could
rewire him. Having no inch authority, of
course it could not be produced.
ThePlyeleisas in the Interest of the re
spondents testified that Dr.9)aketwas very
feeblei and that he could not be removed
Without great danger; that he was well at—
tended to at Mrs. hdoimes', and was getting
better:AM he was of an excitable. dined

greatly aggravated; that the fresh air , and

Would treat him well ? The answer wes, tbat
the effect would bate excite the doctor, and
aggravate his dlsoaae.
Several other Witnesses were examined, and
their testimony wont to show that the doctor,
ever since his illness, was treated with
great kindness, and in the best possible man
ner by those in waiting upon him at Mrs.
Holmes';. that he has never been -restrained
of his uty by either Mtg. Holmes or Dr.
fluthlort, and thathe Is at liberty to leave the
house at any time when able to do so. Some
feets were elicited on ereetemunination—that
the doctor had torn down the window blind, 1
and attempted to escape from the window, but
was prevented; that something bad been
said about the doctor's bark book endpapers,
built did not appear who had possession of

The -testimony was very voluminous, and
from it we gathered that Dr. Dabs hid not
. been living on friendly terms' with his family
for tome time,• that he frequently ate his
meals at hotels -and restaurants, and had
staid with Mrs. Holmes on another occasion
when sick; that he has become estranged
from his family and has a warm friendship
for Mrs. Hemet. An offer was made to prove
that the character of Mrs. Holmes was such
that the members of Dr. Dake's family could
set visit him at her house and maintain their
self.respeot, but the Court rolled out the tes
timonyas irrevelent.
The hear leg:occupied the entire afternoon,
end will be rammed at Pine o'clock this morn -
