Henry Lambert, Esq., our v ry worthy and effteleut County Controller, appeared in the Court of Common Pleas, this morning, and in pursuance of the net of 2!ey Ist, 1861, filed his annual statement of the fiscal affairs of the county. The report is very voluminous, and will be publlified in pamphlet form for the in infornaatien of the tax payers. From a hasty glaneeet its contents we learn that the finan ces of the county are in a very gratifying con dition, notwithstanding the incubus of the railroad debt. The total ordinary expanses for 1862, were $86,000, while the total ordinary expenses of the past year were bat $84,;92—a decrease of over $B,OOO. Whi' , aggregate expenses have been thus Ir dueed, there has been a groat increase xpenditures of some of the departmei a public service. The moat-important i• Rouse of Refuge, the expenses of whiel. ..ice run up to an enormous sum. In 1861 this institution cost the county $8,764 82 ; in 1562, $10,703 16;. and in 1863, $14,247 15. This is a matter which should be carefully invettigsted, and some effort should Lo made to relieve the county from my further increase of this tax. The Court of Common Plans exhibits a large increase in its expenditures. In 1862, the amount paid to jurors was $1,803 ; last year the amount was $3,660. For tipstaves, $923 welt paid last year, against $;411 the previous year. The Coarte Quarter Sessions also exhib its an increase, but not so large as the Com mon• Pleas. This result ' it is said, is attributable to the fast that the institution had on hand, before the increase in price, a large stock of cotton, which is now being worked up into ticking, and sold at an enor mous profit .Lsethe cause be what it may, wthe fact is a gratifying one that the cook leis have been able to earn their own bread. The account of Mr. Floyd, County Treas urer, exhibits a balance in his hands of $51,- 000, while the amount outstanding is s.3.S,utiO, making a total of $- , e,00 0 . All the interest due upon the compromise bonds has been promptly paid, nod the surplus funds en hand are amply sufficient to meet all the obliga tions of the county. Mr. Lambert, under the head of "Railroad Bonds Amount," gives the following interest ing statement: In the month of February, the fol lowing terms of compromise were agreed upon in Philadelphia between the county authori • tiea and a committee of Railroad Bondholders, representing a large number of that eters of creditors: ••• . . .The county to raise by titration annually $130,000, tar payment of intere• ton railroad debt, beeidee $25,000 for sinking fund. The whole ease of indebtednase, both bonds and coupons, to be consolidated to January let, 1443, on which an abatement of 13'-:;• per cons is to be allowed by the creditors. Fund t•- abated amount at 5 per cent.—the new bond to he clear of taxation under the laws . Pennsylvania. For judgments, the bones run 20 years; for balance of debt, 50 year- The old bonds to be deposited with Trristoes, and not to be eanoelled until after punctual payment of interest nn new bonds, for five • years. Attorneys en judgments, and costs of court and expenses, to be paid by the coun ty." The necessary legiidation was procured at illarribbllrg to authorise the opurity officers bri exchange the bonds and conclude a settle ment. By close and accurate cal .elation it was found that a levy of ten mills on the county valuation would be sufficient to meet our engager tits with the bondholders, and at the same time provide for the ordinary annual expendibares. The latter had been reduced under $40,000, and it was confidently believed there was no necessity why sorb amount should for the future be exceeded. . 13y a comparison of the Contingent Warrant tables for 1842 and 1062, it will be perceived that some departments, of the county have. during the mutt past year, increased their ex penditure fully.so per cent., and in these par ticular branches of the public service neither the Commissioners nor Controller have any di rect check on the management. Whilst the enhanced' value of commodities in general may partially account for the increase in some instances, in others it =net be pleaded in justification. She may trade, she may sue and be sued, andshe may convey real estate by &ad or will without the assent or concurrence of hor husband, but oan rho direst hor husband's vested estate" This is the question upon the presmit record. It is of no consequence to this question that the plaintiff's estate accrued to her since the passage of the married woman's act of 15451, because the husband's tenancy by the cartes) , is expressly saved to him by the act. His creditors could not indeed seize it in execu tion daring her life, but still it is a vested estate, the enjoyment of which in possession hi expectant upon her death. Desertion of a wife, however cruel and long continued, does not dissolve the relation. The fatherless husband is still husband, and the law, like that Divine be neficence which descends upon the evil BR well as the good, preserves to him his constitu tional rights. Therefore, whatever force we give to the act of '55, we cannot make them effectual to the divesture of the husband's estate without his consent, and consequently the decree below is affirmed.
