and skillful drivers and conductors, and to see

When a passenger has been injured, the
mere fact of injury is prima Janie evidence of
culpable neglect on the part of the defend-
ants, and it throws 10012 them the bordello(
proiing they were not in fault. And It is
generally 'a question 'for the jury whether,
when an accident has happened, it wu caused
in any degree by a failure of the servants of
' the defendants to do their whole duty. A
jury should, therefore, keep threfelly in mind
what the duty of is railway company Ws pas
senger demands; for, if it has not been per
formed, the failure Is negligence. •
I have said these defendants were bound to
provide good, skillful and care fulconductors
and drivers. If they did not, and the plain
tiff was hurt to consequence of their, having
provided unskillful and careless or reckless

I have said the defendanti were bound to see
that their ears were prudently managed. If
they were not, the want of anoh management
is negligence, and any injury resulting must
be compensated. What is prudent manage
ment is a question for you.
It is plain that even one who is not a car
ter of passengers mast use greater caution
In circumstances of danger. The duty of car
riers is:thrtalnly not less. Where one rail
road atones another at grade, the greatest
caution Is demanded, for then there is ecu
liar danger of collision. Such cross p ings
should be approached slowly with the oar well
in hand, so that it may bo stopped, If nestws
eary,lergeason to . avoids collision. An at
tempt to cross on one road when a car is ap
proaching on the may not be made if
there is the least danger of their coming into
contact. Indeed, there should be no attempt
to cross at all until it-bas been seen that there
is no near approach of another ear, so near en

genus. These rules of law, which will com
mend themselves to your approval as most

the facts as detailed to you by th e witnesses.

DIDICATION.—The new Cotholie church to
