and Ex-Miniiter of the United States to Cen
tral ArtterriPh_ agotinst...SeeretaryfieWard, for
damages resulting • from-the imprisonment of
the former in Fort Lalayetto, :waa, sought to
be removed-from the Supreme Couiit of New
York into the Circuit Court for that District.
Judge Clerks, however, before whom the ap
plication for removal was made refused to
certify the record to the United S t ates Court,
and there the subject rested until Judge Grier
delivered his order in the case of Bodge*.

United•Statet Court under the set referred to,
and the order of Judge Grier was upon a mor
Lion to remit the record to the State Court, on
the allegation that the Me was not within

properly certified into the Circuit Court, and
that it must be tried there in the same way
as if brought there on appeal, or as if - it - bad

cess. This settles the law for this latitude,
and how any lawyer could take- a different
view from that of Judge Grier -it is very hard
to ice. The act of March Ed was designed
expreuly to cover just suet Motes as those of
Jones against Seward and Hodgson against
!Inward, and to refuse-to certify the record of
such cases Into the Circuit Court, or to remit
them when certified, would be to treat with.

has not been assailed for want of constitu

"The order or warrant under which the defend

of authority derived from the President. This was
'color' of authority, whether the substance existed or
notd The argument that color being= accident, can
not exist without substance, may be metaphysically
correct, but has too much subtillity for practical
ap
puatica in the construction of statutes- We do not
think It nnxesary to give a definition of 'color of au
thority' to suit all.cases. For the purposes of this
cam, It Is enough to say, that an officer acting in
good faittrunder a warrant purporting to come from
his superior, whom-ho to bound to obey, it actingen
der 'color of authority,' whether bin superior trans
gresses his power, or the warrant be Irregular, or
pot. This is the question to be tried under proper
pleadings and evidence before &Jury.
"If the state court should assume to refuse to cer

Recruiting - In Exoniple to
Gov. Morton is laboring diligently to pro
mote Gov.,
recruiting in Indiana. - Ile hes
issued an address to the people, in which the
quota of each Coneressional district, and the
eounties (Imposing It, is given. A county
committee is selected at each county seat to
divide the-county quota among the townships,
and co-operate with the military command
ant* and local recruiting tants: They , are
also to select a corresponding member in each
township, who will associate with him four
other citizens of the same township, In order
that the sub-districts may be thoroughly eau
vassild for recruits. The Governor says that
if this system is thoroughly carried out the
quota of the State may be filled in twenty ,
days. Tho call on the State is for 18,597 men,
of whom 2,458 have already been tarnished,
leaving 18,141 yet to be supplied.
The Indianapolis Jawna4 of Friday last,
says that the new regiments are now filliog up
rapidly, and that some of them will be ready
for the field in a month, if not sooner. There
is not the same promise in all the districts,
but in none is the work falling behiod what
was expected. The evident and acknowledged
exhaustion of the rebellion, and the certainty
that a large increase of our army will crush
it almost without en effort, are impelling
young men into, the ranks that they may
share the glory of the victory in the greatest
obit war in the history of the world. This
motive, in spite of all the weariness and dis
trust that slow Movements and numerous
blunders have made, is still strong, and still,
as slow regiments' are called for, fills up the
ranks, and ands out fresh energy and spirit
to the_fight. There are other influences at
I workitio doubt, but we hail, seem and heard
! enough of the feelings of our soldiers, not
°lacers, but privates, to feel certain that many
II heart enters the ranks with a warmer
thought of the glory it is to pin than of
the pay it may get- And Ails this is cherished
we shall not abandon a jot of our eon-.

Gen. Foster hu established the following
rules for letters going South:
1. No letter must exceed ono pap of s
letter sheet, or relate to other than purely ,
domestic , matters.
2. Every letter must be signed by the
writer's name in full.
8. All letters must be sent with live cents
postage enclosed, if to go to Richmond, and
ten cents if beyond,.
4- All letters must be.enolosed to the com
manding general of the Departmentof Vir
ginia and North Carolina,. at Fortress Mon
roe, markedonthe ontside,"for Big of trace."
No letter sent .to any other address' will be
forwarded. _.
All letters sent to Fortress` Monroe, with
out a strict ; compliance. with. these ruleit,
