to New York, where, under an assumed
name, he engaged in the purchase of men
clluendiss, principally dry goods. Upon
:this state of facts, Col. Bomar Nuclear, U.
S. Provost Marshal, very properly had him
. arrested and confined as presumptively a
spy or emissary in theUrvice of the rebel
lion, but offered to release him at ono° on
the simple and easy Condition of his taking
an oath of allegiance" and fidelity to the
Unitedlitates. This he refused to do, but
sued oat instead a writ of habeas corpus be
fore Hen. Joan H. McCrea, City Judge,
who, after due hearing, sustained the writ,
overruled the action of the Provost Mar

This Judge McCue has been figuring
recently in copperhead meetings, so that
his decision is in keeping with his record
as a politician. Here was a man who be.
lenged to a State in open rebellion, and
who, by his refusal is lake the oath of al
legiance, virtually admitted that he was a
rebel, and all whose surroundings proved
him to be not only a rebel but an active
emissary, and probably a spy, let loose
to igo on with his treasonable practices by
• a partisan Judge, on-the ground that he is
entitled to "all the privileges and immn
- allies" to whish he would have been enti
tled had Alabama not seceded, and had he
Continued perfectly loyal.
The habeas corpus is a great and pre
cious privilee ‘ when properly used; but
like all other things, If misused and
perverted, beco the direst of curses.
Ite intent is to shield the innoont and the
helpless against •, arbitrary, irresponsible
and despotic; power; but here it was used
to screen the guilty, defeat the ends of jos
ties and lay bare the bosom Of the nstion
to the strokes of its enemies. This decision

outraged, by having a rebel and a probable
spy exalted is his own level in point of
privilege, and that his country is impetr

Perhaps no other man in America is ca
pable of anything so mean and contempti
ble as this. The soft-hearted Governor of
New York, through pure sympathy for the
negroes, declinesto permit them to be
placed in "dangert and kindly assures
them that "the dreadful and unnecessary
lUsflce of life,' in case they went into
battle, is nottobe thought of for a moment.
This, for a leader of a party which classes
all who differ with it as "Rigger worship-
Pell," is not so had; and our white soldiers
will be glad to know that, according to so
high a democratic authority, they are the
men who must occupy positions of "extreme
danger." If, instead of this whining piece
of deceit and falsehood, Gov. Seymour had
plainly said to these colored patriots, beg
ging for an opportunity to enter the field
for the Nation's defense: "No! I will not
co-operate 'with you in your efforts to up
hold the honor of the nation. Ido not de
sire to see a war succeed which disenthrals
your race, nor will I raise a finger in rein
forcing our armies, wasted by war; and
especially I frill not suffer—so far as I can
prevent it-4 people to gain an honorable
record, whose proper condition is servitude"
—he would have told more truth than he
has lately been in the habit of doing, and
would also have shown a far clearer "dem
ocratic" record, than his false and hypearit
ical answer to the negro committee makes
for him.
—But even the organs of his own party
are not all prepared to endorse him in hie
dishonest affectation of philanthropy. The
Poughkeepsie Bras, a well-known Demo
cratic journal in hie own State, thus re
bukes the imposture attempted to be played
off by the Governor in this false and non
sensical' profession of sympathy for the
negroea :
"According to the belief of many, this
war is being carried on in the interest and
for the sake of the colored man. Why,
then t should he not be _allowed, and even
relayed, to bear his 'hare of the burden
and danger of the camp and battle-field.
As for Governor Seymour or any one else
having too much sympathy for the bison
to allow them to do so, it 18 sheer nonsense.
If they have any such sympathy it is of a
kind that the people do not understand,

"We hare never yet been able to see
why colored men should not be allowed to
fight if they want to; nor any reasons why
regiments of colored men should not be rais
ed, if they can be; nor any reason why the
escaped elnres who come into our lines
should not be made effective in helping to
dig entrenchments, build the Torts, tight
the battles, bury the dead, and do any other
thing that can be coaxed or required to do
against the rebels for their discomfiture."
This is as effective a rebuke as a friend
could be expected to administer, and there
is so strong a smack of common sense, and
sound argument in it, that we willingly
take our leave of Governor Seymour in
such hands as he has fallen into, even of his
own party, on this 'negro question.'
The Radical Emancipation Question
The success of the radical Emancipation
ists in electing their candidates in several
districts to fill vacancies, occasioned in the
state convention by the resignation and ex
pulsion of rebel members, is one of the most
extraordinary Big& of the progress of rad
icalism yet witnessed. In McDonald coun
ty, Cape Girardeau county, Webster county,
Chariton county, and one or two tag*
radicals are elected. In the Chariton
district, the new' delegate succeeds no
puss a personage than Sterling Price,
who was elected. two year. ago without
opposition. How . Chariton gives Win
slow, radical, two hundred and forty plu
rality, and one hundred and thirteen
majority (over all) In a poll of about half
its former vote—a large turn oat for spe
cial election. These results have been
achieved in counties where there are no
soldiers to interfeis with the free voice of
voters, and where the voting is. viva vote,
and every radical is therefore known to
his, pro-slavery neighbors. Several other
delegates have resigned, and elections are
to be held on the -10th mast,, to fill the ye

as a candidate whose publicly avowed
platform is emancipation without comport

The Fourth of July Celebration in
Philadelphia—Place of the Cele
barites' Changed.
A dispatch from Philadelphia says:
The Union League intended to hold a
Fourth of July celebretion at Independence
Square, but u the democratic party hold
their usual anniversary at that place in the
morning, and have a prior claim which
they refuse to yield, the celebration of the
Union Leagie will be held at Fairmount
Park, to which place the prodession will
march.
The Union League committee addressed
a note to the democratic committee, in which
they spoke of the national and unpartisan
character of the , propeeed celebration, of
the fact that the President and other dis
tinguished citizens would be present. To
this the democratic eommittee replied that
they have invited 'diltingalshed statesmen
and patriots trim other States to unite with
them on the 'occasion, and a cordial invita
tion is extended to all who are loyal to the
Conatitutlon, Unloit and laws, and who re
cognise freedom) of speech, liberty of the
press, protection from arbitrary oppression
and vindictive arrests.- The request to

Square is therefore deoUsed.
