AN order has been issued by Superin

Review. - forbidding conductors or engi
neers from making up any time on their
runs during the ciild weather. The pres
ent condition of iron rails and the danger
arising s from broken ear wheels and axles
render it rosemary that the ',utmost pre
caution be taken to prevent; accidents. ;

watch over his stoves and heaters. In the
effort' to keep out the cold there is danger
that larger fires will be built and kept up

Too much care cannot be taken with fires
in such bitter cold weather as this. Ser
vants am prone to fill stoves and furnaces
with coal, open the dampers and let the
fire take care of itself. Under the terrific
heat thus generated weak places in the

mine the validity of a judgment entered
on a warrant of attorney contained in a
note for 6300.00, given about 1858. Judg
ment was enteral' in 1876 issued after
which, the defendant obtained a rule to
open the judgment alleging that the note
had been paid in full, being applied on a
contract for real estate. Verdict for the
defendant.

The heirs not being parties to the original
action, the object of.this proceeding, was
to bring them in and charge' their estate
with the lieli of the judgment. Plaintiff
'contended that the judgment obtained
agaltuste the Executor was conclusive, be-1
ing ret adjudkata, and that the heirs I
could-not now contest the validity, of said
judgment on its merits. Defendant claim:
that the heirs not being - parties to the
original judgment, were not concluded by
it; but might make any - defense that
would have been proper for the Executor'
to make. The claim of plaintiff was bar.
