SUM= Springhill, July 10, 1874. , THE TOWANDA - CIDSLETERY.—By an act passed by. the , last .Legislatuze; approved May 19,1874, the courts are authorized, upon the petition of the managers of anylncorporat ed.c.emetery company, to transfer the oemetery to the authorities of the borough in, which it is situate:ld, if the borough authorities; consent to such transfer, and the same is made .without cost to the borough. Upon such transfer being made, the.borough authorities shall hold and exercise all the powers and privileges of such corporation; and may,purchase land within Or beyond the borough limits. not exceeding thir ty acres, for the extension 'of the cemetery, and may raise the means by taxation to pay for the same. • They may lay out- the grounds of each cemetery, sell lots, and manage the same as the incorporated company could have done. By'ariother section of the ,same act, the courts are authorizedto order the removal of a burial ground, or to regulate the care of it, as the public good may'reiviire. Although this is a new system in Pennsylva nia, it has long been practiced in the State of New York, and probably in other States. 411 the neighboring towns, .iillages, and cities, north of us, .have their public cemeteries be , 'longing to the village or city. We could refer to those of Binghamton, Owego and Elmira. A commissioner Is appointed by the village or city counsel, who has charge of the cemetery, and the grounds are generally in a condition that puts- to shame the neglected burial grounds in our State. A lot of ground is gen bought before the town attains .: a large , size, and if the place is a fl ourishing 'one,- the sale of lots repays the coOof land and impreve- Ments. Theke Is a manifest propriety in the 'oorough authorities having charge of the places of burial, especially in this countit where from emigration the surviving friends very soon leave the neighborhood. The Towanda Cemetery was commenced by the gift of a half acre of ground by Mr. SraLtt- ING, in which the citizens buried their dead as they chose. About the year 1838 a larger -piece of land was bought south of the old ground, which was conveyed to trustees, and lots were sold and conveyed to the purchasers. After wards Mr. RUSSELL bought land north' of the old ground, laid it out as a cemetery, and sold lots for burial purposes. His unsold ground now belongs to ono of our citizens, who sells lots for this purpose. No act of incorporation has over been granted, although it can easily bo obtained by a petition to the court. There is nothing to prevent those who have buried their dead in the old ground, those 'who have lots in the second anal in the third purchase, joining in`a petition for a chirter Of uicorpora lion.- After, that is granted, the managers can avail themselves of the Act of 1871, to transfer ,the property to the town council, if they accept the trust. The present grounThs having become too small, the town conned cau, P if it is thought best; procure other grnund for en larging, or even if it becomes necerisary, remov • jug, the present cemetery. Burial grounds should not be private property, and it would be much more satisfactory to the public to know that all money paid for lots w. devoted to ornamenting and maintaining the--ground under the care of the borough authoritios, hav ing perpetual succession, and under a system which has for many years worked satisfactorily in a neighboring State. - , If it should be objected that additional_ bur thous of, taxation would be imposed on the bo rough by this measure, it may be answered that in the public cemetery is the only property of the city that pays expenses. -Lot our citizens now take hold of this matter, and provide a suitable last-resting' place for them selves as well as for their departed friends.
