-A rather strange portion. of the
theory of the defence NVB4 reached
last evening and gave rise: to much
dischision On the part of the counseL
Stated'briefly the °fleet that
the deposition or dying declaration

The defence desired to explain thin
instruMent by showing that it was
gotten up for the express purpose of
obtrkiri;ng the money on the insurle
policy , and for no other purpose; th t
the various expressions in it state
things that are necesSary to exist be
fore the money on the policy can be
obtained. For this purpose it is
sought to 'introduce in evidence the
accidental policy ticket to show the
provisions • contained on tUt back
thereof in relation to certain contin
gencies in which the money on it
will be forthcoming.

ness sat five or six feet off; Shader's
face was turned towards Squire Tidd,
