happen ?" thinks this queStion was
asked but not answered the first time;
ono ,question . asked was, "did you do
it yourself ?". which Shader answered
negatively, either no, or shook his
head, can't say which; couldn't state
positively what the other questions
and answers were. Porter's face was
froth the witness; am not sure that
he heard Porter say anything about
its being an accident; witness' recol
lection was, that a question was ask
-ed by-Porter as to its being an aeci
dent; have no reeollection as to the
answer; witness remained in the
room about an hour; at the time
theite questions were asked Mr. Sha
der seemed alinost linable to talk, he
answered with a great deal of difft
, culty; when - he spoke-he spoke very
low, and groaned between each word,
he Nomited-several times . about this
time; can't tell which answer between
the words of which he groaned; he
groaned at about every breath; to
. one question think that Shader said
" no ' or " I guess not "• heard some
words of a name and address which

day; let him into the house; about half-past ten

Mr. Ward told witness to get his overcoat, his

was fired in the dining room where these two
persons wen; was in the kitchen when heard

was closed; after pistol was fired went away;

ness were in kitchen alone; the others came in

persons in the kitchen left the hease together
when the,shot was heard; remained away until
the heat morning; there was no ono :in the
dining room besides Katie and Mr. Ward and
. Mr. Shader; heard no noise in the dining room
witness wag weelaing dishes when ebe heard the
conversation; was smiting down when shooting
occurred; had finished the dishes, during the
conversation was standing at the sink, near a
enplward that had an- opening in both rooms,
the kitchen side wax open, the dining-roam side
'shut; it was about fifteen minutes after the
dishes were finished that the shooting occurred;
witness was sitting near the stove in the kitchen..
To Mr.- Peck: Mr. Shader and Mr. Ward
_ acted very friendly when they were together;
' pleasant and sociable every time witness saw
them: Mr. Ward told witness to have dirther
ready at four o'clock for himself and Mr. Stie
r der; Mr. Ward told witness to prepare an
apartment for lie. Shader for, the night; Mr.
W. told 11:10 thif in the dining room; Mr. Sea
der was there; this bed-room- was next to the
ono Mr. Ward occupied; this was before the
carriage came; and Mr. Ward's directions 'were
before they spoke of going to ride; got Mr.-
Ward's overshoes from his own room, and his
' coat and • hat from the. hall; Billy Thompson
went into the dining-room once.
To Mr. Carnochan: Saw no pistole in the
room when I went up for Ur:Ward's overshoes;
when witness saw Mr. Ward about two o'clock,
he came in from the Library to the dining
room; heard Mr. Shader speaking in the libra
ry at this time, but didn't see him; didn't hear
them talking in the library after this.
• To Mr. Peck: Heard no conversation In the
dining-room of an angry character, no high
words, no scuftlieg, only ordiniry conversation;
saw wino on the table but didn't see them
drinking it;. went up stairs with Katie and she
brought down a bottle of champagne and a
bottle of wine.
- 'To Mr. Carnoehan: This was not at dinner,
:hut in the morning.
To Mr. Peck: Saw bottles of wino on the
table also; think they came into dinner in the
dining-room about five o'clock; the last time
witness was in the dining-robm they were both
at the'table cracking nuts; can't say how long
it was from the time went into the dining-room
last until heard the pistol shot.

: The bottles on the table
looked to bo the same that. Katie got; couldn't
sac whether they were or not.
