belonging to Charles T. Murphy, east by lands of Howard

The petition of Cyrus Fuller, Guardian of C. J. 1-ee, a
minor son and heir of James Lee, late of the tow nship of
Derrick, in -aid county, dee'd, is presented, setting forth
that the father of oaid Charles J. I.ee died intestate, leav
ing a widow, to wit : Jane Lee and issue, six children,
to wit : William E. Lee, Margaret Jane, intermarried
with David Ne-bitt, Thomas E. i.ee, James If. Lee, Jo
seph J. Lee and Charles J. Lee. the two last named of
whom are still in their minority ; and that Pembroke
Squires has hi en duly appointed guardian of said Joseph
J. Lee, and that the -aid intestate died seized in his des
iiic-ne as of tee of and in a certain messuage situate in
the township aforesaid, which after deducting fifteen
acres set off to said Ja e Lee, widow as aforesaid, is
bounded and described as follows, to wit: North by lands
of William llillis, east by land ot Margaret Rhikcr and
11. W. Tracy, south by lands of said Tracy and the afore
said land set off to Jane Lee. and west by said Jano
Lee's land and find of Robert Boyd and David Xesbitt.
Containing eighty-nine aeres, or thereabouts, with the
appurtenances. No partition of the said estate having
been had, lie prays the Court to award an inquest to niako
partition of the premises aforesaid to and among the chil
dren and repic-int atives of the said intestate in such
manner and in such proportions as by the laws of this
Commonwealth i- directed, if such partition can be trade
without prejudice to or spoiling the whole, but if such
partition cannot be made thereot as aforesaid, then to
value and appraise the same and make report of thoir
pro. eedings herein according to law. Whereupon on tho
leading of the petition and on motion ol Mr. Mercur, tho
Court order an inquest in accordance with the preyer of
the petit ion. And further direct that a a notice lie given
in the Bradford Reporter by publishing a copy of the writ
for six week- prior to the first day of next Term. and that
the tin' e first numbers be forwarded to the said William
E. Lee. ho resides at Fremont. Nebraska Territory.
