Chief Justice Fuller tenders the Decision
Unexpectedly.
JCSTICE BHIEAS GETS HIS DISTRICT
"Washington, Oct 117. The United
States Supreme Court, by Chief Justice
Fuller, to-day affirmed the judgment ot the
Michigan Supreme Court, upholding the
constitutionality of the famous Miner law,
providing for the election of Presidental
electors by Congressional districts instead of
by the State as a whole. The court holds
that the fourteenth amendment did not
limit the right of a State to fix a mode of
choos'iDg electors. The opinion nas unani
mous. rJ Chief Justice Fuller, in announcing the
conclusion of the court on the case, said
' that the court made the announcement at
this time becaure ol an exigency suggested
by counsel requiring early action. Here
after the court would file an opinion setting
Jorth more lully the prounds on which it
had decided the case. In his brief an-
. liouncement of the decision the Court sud
that in the case ot JlcPherson versus
Blacker, the Secretary of State of Michi
gan, in which was drawn into question the
public laws of the State of Michigan (the
Miner law) providing for the election of
Presidental electors by Congressional dis
tricts and lor the election of electors-at-large
bv dividing the State in two parts the
Supreme Court of Michigan had ruled ad
versely to the plaintiff in error upon the
i validitr of the local law. In so deciding
l the Federal question was necessary to be
passed upon and the validity of the Consti
tution and laws of the United States had
been drawn into the question because of
this Federal question.
No Doubt as to Jurisdiction.
The Chief Justice said that this court
ruled that it has jurisdiction of the case
under Section 709, Revised Statutes, the
Democrats having raised the point that the
question was one of loeal law, in wnich the
decision ot the State Court was final. Hav
ing established its juriadiction in the mat
ter, the Court then dashed to pieces the
hope of the Republicans who had appealed
the case from the Michigan Supreme Court,
bv affirming the decision of the Michigan
court, which had ruled that the Miner law
was constitutional.
The Chief Justice said the Court ruled
that in view of the languacte of the clause
of the Constitution giving Legislatures the
right to determine the method ot electing
Presidental electors, and its contemporan
eous construction on the act cannot be held
invalid lor want of power in State Legisla
tures to pass such a law. "We are clear,"
he added, "that the clause ot the first sec
tion ol Article 2 of the Constitution has
not been changed by the lourteenth amend
ment, and that the law is not obnoxious to
that amendment."
Colonel Duffield, of Detroit, in arguing
the case lor the Eepublicans had insisted
that the fourteenth amendment established
the citizenship of the United States where
the State citizenship had heretofore been
supreme, and that its language lorbidding
the abridgement of the pnvilegs ol citi
zens had the effect of preventing the States
lrom changing the method f choosing elec
tors then in vogue.
A Great Help lor the Democrats.
The decision to-dar obliterates the last
hope of the Eepublicans that the Miner
law might be invalidated in court, and that
the election in the coming Presidental con-,
test might be decided on the old plan of
giving the whole vote of the State to the
party having a plurality in the State at
large. It is conceded that the result will
be to give at least a part of the electoral
" Tote ot Michigan to the Democrats.
The .Supreme Court this afternoon ad
journed until Monday next. Chief Justice
Fuller announced that on motion of At
torney General Scott, of Virginia, a rule
would be issued returnable on the second
Monday in November, calling on United
States District Judge Paul to show cause
why the case of Deputy United States
Marshal Joseph C. Currico, charged with
the murder of a man he wanted to arrest,
should not be transferred to the State
court.
Justice Shiras was assigned to the Third
Judicial Circuit, to succeed JusticeHarlan,
temporarily assigned to that circuit on the
death of Justice Bradler.
Attorney General Miller moved for a
writ of certiorari to bring before the Su
preme Court the case of the United States
vs the steamship Itata. In this case the
lower court decided against the right of the
United States to seize the Itata lor carry
ing arms to the opposition to Balmaceda's
Government in Chile, and a speedy deter
mination of the question by the highest
court is wanted. ""
Chief Justice Fuller's Opinion.
The following is the lull text of the pre
liminary opinion rendered by Chief Justice
Fuller in the Michigan case:
Xa 1170 McPhtrson et al. vs. Black,
Secretary of State. In error to the Supreme
Court of Michigan.
We are or the opinion that the objections
to Act No. 50 of the public law of MichUan
of 1S9I, tacj upon matters of locil law,
having been ruled by the Supreinn Court of
Michigan adversely to plaintiffs in error,
whose conclusions in that regard we are
not authorized to revise, tlio decision of the
Federal question involved was necessary,
and the validity of the law as repugnant to
the Constitution and laws or the United
States having been drawn in question and
decided, and tho decision being in lavor of
its validitr, this court has Jurisdiction under
Section 709 of the Revised Statutes. Tlio
judicial power of the United States extends
to all cases of law and equity arising under
the Constitution and laws of the, United
states, and this is a case so arising, for the
reason Just slated.
We concur with the Supreme Conrt of
Michigan, that so far as Act Nul 50 conflicts
rith tne act if Congress oi Februarys, 1837,
in the particulars pointed out, and in l ex
pect of vt Inch Conareis possesses the power
to legislate, it is inoperative only to that ex
tent, but that tho act is not for that reason
old, and may stand as so modified.
We also hold w ith that Court that in view
of the language of the second clause of the
first section of Article 2 of .the Constitution,
and the contemporaneous and subsequent
construction of that language tn practice,
this act en nnot now be held invalid for w ant
of power In the State Legislature to provide
for the appointment of electors of President
and Vice President of the United State", as
therein prescribed, and we are clear tnat
that chiii-f o the flist section of Article It
lias not been changed by the louiteuntii
amendment tn tlio Constitution, and that

the ground of conflict with that amend
ment. We malco this announcement at this time,
because ot an exUency suggested as appa

State statutes, and will hereafter file an
opuiou stating fully the grounds of this de
cision. The judgment of the Supreme Court
of Michigan is affirmed, and tne mandate
w ill issue at once.

The Young Men's Tariff Clnb Snnday
night voted (25 to the parents of each of
the boys killed in Saturday night's street
v' car accident. This was done because the

kicked in the stomach, Saturday night, by

FIRED ON A CHILEAN SHIP.
The Trouble Caused by Rivalry Between
Two Consuls on the Coast.
Port TOWNSEND, Wash., Oct. 17. The
Chilean bark Augusta was fired upon late
last night in the Straits, four miles below
here, by the Unittd States cutter Oliver
"Wolcott The August attempted to leave
Puget Sound without a Custom House
clearance. The trouble was occasioned by
acontest between Chilean Consul Macon
dray and Vice Consul Delion at Tacoma as
to which shall transact business lor the
Chilean Government at Puget Sound,
Tne Augusta arrived here several weeks
ago. She surrendered her register to.Con
sul Macoudray and proceeded to Tacoma to
load a cargo. " Vice Consul Delion advised
the captain to demand the register from
Macoudray, and it relused to proceed to sea
with a temporary register provided by
Delion. Macoudrav instructed the vessel
to clear lrom Port Townsend. As the ves
sel was going out to sea she was overtaken
by the Wolcott, but would not heave to until
fired upon. "The vessel is subject to a fine
of?500. .
The Colored State Fair.
Harrisbdrg, Oct 17. The first State
Fair under the auspices of the colored
people of Pennsylvania, opened at the
Auditorium to-day. There are over 400
exhibits, including all kinds of products.
It will continue ten days.
