A KOT GUILTX PLEA DISALLOWED Meadville, Sept. 3a At the qpening of court this luorning the defence tuoVed for a verdict of not guilty in the cases of G. E. and T A. Delamater, which was refused. G. W. Delamater .a sworn and testified as to the value of the assets of the firm and its individual members. The Delamater block liad cost $149,000 and had a rental value of 85,000. Thft total assets, according to the valuation pi Delamater, was 51,127(450. The witness said lie only had a general know ledge ot the business of Delamater & Co. , during 1887. "68, '89 and '90. He had always ' estimated his, property as being amply Mifficicnt to meet his obligations. He be lieved at the time in 1890 that the bank that Is, the partners taking together was j'erlcctly solvent. Before the failure the witness was en paged in politics and business enterprises in other cities. He was also in the State Senate. From the 1st of April until the election the witness spent less than ten full days in Headville. At the time of the fail ure, G. W. Delamater was out of town and returned in time only to eign the assign ment papers He had no knowledge of the assignment nntil he returned to Meadville on the morning of the assignment, Decem bers. In the week of the failure the wit ness deposited 5150,000 in the bank of the Dfiamaters. Mr. Delamater said he had tried to do the best he could for creditors, and made a written proposition to them. In the mean time he, With his lather and brothers, had been arrested and indicted. He saw that the creditors were losing confidence in him. He had no recollection of saving to the committee of the creditors that the liabili ties were 51,000,000 or 51,250,000, bnt he did say abont ?S00,000. The purpose of his meeting with the creditors was settlement and the avoidance of the sacrifice of the val uable property. 'Witness did not make oat the list ot depositors and the amounts due, which had been given to the creditors, but he believed it to be correct He said that G. B. t and T. A. Delamater had never had anything tc do in the bank actively. He said he believed the 558,000 due to the Phil adelphia Finance Company was good to day, and would be paid. The defense produced a number of certifi cates ot deposits which had been paid be fore they were due, to show that detendants had no knowledge of their insolvency. The testimony will close to-morrow.
